【摘要】 巨额财产来源不明罪是指国家机关中从事公务的人员或者依法以国家工作人员论的人员的财产或支出明显超过其合法收入,差额巨大,而本人又不能说明其合法来源的行为。本罪侵犯的客体是国家工作人员职务行为的廉洁制度和公私财物的所有权。该罪的客观表现为(1)行为人的财产或支出明显超过其合法收入,且差额巨大。(2)司法机关无法查清巨额财产的来源。本罪是对行为人“拒不说明”财产来源的不作为行为的惩罚。本罪的犯罪主体是特殊主体,即国家工作人员。本罪的主观方面是直接故意,行为人明知财产不合法而故意占有和支配。认定巨额财产来源不明罪,应注意三个问题,即巨额财产获取的时间段、固定时间段内全部财产的增加值、犯罪嫌疑人在固定时间段内支出(消费)金额等。本文从巨额财产来源不明罪概念及立法特征、立法现状、目前法律体系所规定中巨额财产来源不明罪的构成、认定及处罚、量刑分析等环节着手进行阐述,并对巨额财产来源不明罪在司法实践环节产生的疑难问题进行归类和分析,在此基础上,指出了巨额财产来源不明罪在立法上存在问题,并提出立法完善的几点建议。更多还原

The subjective aspects of this crime is directly intentionally, knowingly property is not the perpetrator legitimate and intentional possession and disclaimer. That huge amount of property of unknown origin.
