【摘要】 随着我国科技的不断进步和社会经济的快速发展，刑事犯罪领域展现出来的犯罪类型、手段和形式也日趋复杂多变。一些智能化、组织化、集团化、专业化和无明显被害人、无明显作案现场、具有极强反侦查功能的犯罪层出不穷。犯罪手段和形式的变化也在催生着常规侦查手段以外的其他侦查方法的发展和应用。秘密侦查作为一种主动型侦查手段，在侦破现实性重大、复杂、疑难案件过程中起着无可替代的独特作用，从而被各国侦查部门所普遍采用。但是，由于秘密侦查自身所具有的封闭性、不透明性、难以监督和控制以及容易走向“暗箱操作”等特点，加之我国法律缺乏有关对实施秘密侦查法定程序的具体规定，结果是：一方面导致侦查机关在实施秘密侦查行为时的不规范，秘密侦查手段的效率难以充分发挥；另一方面，也导致侦查机关为了片面追求侦查效果而贸然采用秘密侦查措施，从而造成侵犯公民基本权利的消极后果。基于此，对秘密侦查进行立法规制就成为必需。本文中，笔者从秘密侦查的基本问题着手，考察了秘密侦查的概念、分类、特征、基本原则以及中外秘密侦查史，通过对秘密侦查的功效进行解读，对中外秘密侦查立法现状、模式及其特色的比较研究，分析了我国秘密侦查立法缺失的消极后果和立法滞后的原因，从而在借鉴国外有关秘密侦查立法模式的基础上提出了我国秘密侦查法治化建构的初步设想。更多还原

【Abstract】 As the advancement of science and technology and the development of economy, the types, measures and forms of crimes are changing frequently, which showing intellective, organizational, professional, and having no distinct victims, no clear committing scenes, and having strong abilities to defend investigation. Other measures and forms of investigation are being developed and applied along with the change of the crimes. Being a kind of active measure, secret investigation has unique effect in investigating important, complicated and difficult cases, therefore, it is applied by most countries all of the world. However, secret investigation is close, opaque and difficult to be monitored and controlled, and in addition, there have no regulations about applying secret investigation in our laws, so, the actions of the spy department are not regular, and the efficiency of the secret investigation can’ t be exerted completely and easily to be trespassed on the basal rights of the people. Based on the realities, it is necessary to legislate on the secret investigation. Here we entered the study on the basic issues of secret investigation, from seeing about the concept, studying the categorizations, the characters and the representations, the basic principles, and the histories of different countries. Furthermore, the efficacy of secret investigation is studied. And then, compared the models and characters of secret investigation with that of foreign countries’ , analyzed the negative aftereffects and the causations, then, we put forward the proposal about setting up the legal system of secret investigation in China.更多还原
