房地产登记赔偿责任制度研究

【摘要】 在肯定人之有限理性的前提下,由特定人所主导和操作的房地产登记行为难免会发生错误,而登记作为房地产物权的表征方式,其错误将会给权利人造成较大的损害,并损及正当的交易秩序。故在登记错误现实发生时,法律就必须为当事人提供妥切的救济措施,这是立法者的当为之作。然而由于我国目前在对房地产登记救济制度的研究和立法上尚不系统,并缺乏有效的指导思路,既有的涉及登记的法律规范性文件在登记错误的救济方面仅笼统地规定了登记机关的赔偿责任,而对引发登记错误的申请人或第三人的赔偿责任及因登记机关和申请人或第三人的“混合过错”所引发的赔偿责任承担问题鲜有细致之规定,由此引发的实践结果存在不少可商榷之处,这种现状应该说为学界提供了较大的探讨空间。本文在对登记行为的性质重新审视和认识的基础上,对我国的房地产登记赔偿责任在不同主体、不同主观状态下的确定与分配问题进行了探讨,本文共分以下部分:引言介绍了本文的研究背景和现状,分析了完善房地产登记赔偿责任制度的重要意义,并交待了本文的主要研究方法。第一章是“房地产登记赔偿责任概述”。首先介绍了房地产登记赔偿责任的概念和特征,其次,根据不同的主体对房地产登记赔偿责任进行了分类。第二章是“房地产登记行为性质与登记赔偿责任”。本章在对目前我国登记制度与西方现代登记制度不同的历史发展轨迹和现状比较的基础上,对我国登记行为的性质提出了自己的见解,并阐述了登记行为的性质界定与登记赔偿责任的密切关系。第三章是“房地产登记制度模式与登记赔偿责任”。主要就我国房地产登记模式的制度选择,及其与不同主体登记赔偿责任的关联进行了阐述。第四章是“房地产登记赔偿责任之确定与分配”。本部分主要在区分造成登记错误的不同主体及其不同的主观状态的基础上,通过较典型的案例,对各自的责任确定与分配进行了较细致的探讨。第五章是“房地产登记赔偿承责方式之完善”。主要分析了我国登记赔偿责任承担方式的不足,并就完善登记机关及登记申请人和第三人承担赔偿责任的方式提出了自己的建议。最后得出结论,在确定登记赔偿责任时,应当区分不同主体及其不同主观状态,分别适用连带责任、按份责任和补充责任原则,合理的分配赔偿责任,既要保护权利人的利益,又要体现法律责任的公正、公平。

【Abstract】 Human being’s nous is limited, so the real estate registration by operator will be have registration errors inevitably. Because the registration is symbol of the real estate property rights, so the wrongs will cause great damage to the person and the trade order. So when the registration is error, the law must provide relief measures for victims. This is responsibility of legislators. However, due to the current lack of in-depth study of the real estate registration liability, legislation also has its drawbacks. This has resulted in many problems in practice, which had provided more room for academic research.The article analyzes the liability of real estate registration .It is divided into five parts:The introduction of this paper introduces its background and current situation, analyzes the significance of improving the liability of real estate registration and the main research methods.The first chapter is a summarization. It introduces the concept of property registration and features, and its classification.The second chapter analyzes the nature of the registration and its close relationship with the registration liability.The third part discusses our country’s real estate registration model and its relationship with the registration liability.In the fourth chapter, the author advances own viewpoints on allocation of the real estate registration liability among the different peoples.The last part is the improvement of the commitment to the registration liability. It analyzes inadequacies in the existing system and put forward suggestions on improving.The conclusion is when determine registration liability, we should consider different entities and different subjection state, allocate liability rationally.
