不动产登记制度研究

【摘要】 不动产是人类社会极其重要的物质财产,它既是人类赖以生存的生产要素,也是人们维持生存和生活必要的物质保障。不动产物权登记就是国家强化不动产管理、确认不动产物权归属最重要的根据。登记内容的正确与否,不仅影响到交易当事人的利益,而且影响到交易的安全和秩序,乃至整个社会经济秩序。本文分四个部分论述我国不动产登记制度:第一部分是“不动产登记内涵界定及价值定位”。首先介绍了不动产登记的基本理论,包括不动产登记的含义以及不动产登记制度的性质。而后论述了不动产登记价值,从保护真正权利人利益、保护善意第三人利益、保护交易安全三个方面分析,对不动产登记的价值进行定位。第二部分是“不动产登记的效力选择”。主要就不动产登记的效力含义、效力的基础,重点论述登记公信力和推定力,以效力选择来确定不动产登记的程序设定。第三部分是“不动产登记的程序构建”。本部分主要讨论登记申请机制,界定申请的性质、申请运作以及申请的法律效力,在实质审查方式下,探讨登记程序中的启动程序和审查程序、审查结果等登记程序的运行。论述更正登记、预告登记和异议登记等特别登记程序的重要性和设立的必要性,提出完善不动产登记程序的方向。第四部分是“我国不动产登记制度的完善”。先分析不动产登记的现状和主要存在的问题。从不动产登记程序、不动产登记错误的救济途径以及错误登记的赔偿责任的确定三个方面进行制度方面的完善,提出自己的建议。通过民事诉讼解决赔偿问题,实现物权法的规定,完善不动产登记制度,使之为保护当事人发挥更大的价值和作用。更多还原

【Abstract】 Immovable property is extremely important in human society, not only it is mankind’s survival factor of productivity. But also it is necessesity to maintain life . Real property registration is a strengthening of real estate management, recognizing that the most important under the ownership of real property.
