【摘要】 随着我国旅游事业的发展,中华民族几千年的文明史,孕育了我国大量具有民族特色的文物旅游资源。其中属于世界文化遗产的24处,位居世界第三。文物旅游事业的发展,使文物旅游资源开发利用中的保护问题凸现。鉴于我国目前文物旅游资源法律保护的现状,本文就我国以公有制为基础的市场经济条件下,文物旅游资源开发、利用中的法律保护进行了比较全面地分析、研究,目的是通过完善我国文物旅游资源法律保护的制度体系,加强对文物旅游资源的保护、实现文物旅游资源的可持续发展。文章在结构上分为三个部分:第一部分主要分析、论证了我国文物旅游资源法律保护的基本理论,其中通过对文物旅游资源概念与特征的辨析、我国文物旅游资源法律保护的社会、经济、历史的重要性分析,得出我国文物旅游资源法律保护制度在循环经济理论的指导下,应该注重建立预防为主、全程控制的规划制度体系,实施文物旅游资源清洁生产的制度体系,制定符合生态规律的保护制度体系,以此保障文物旅游资源法律保护制度价值目标的实现。第二部分以集我国文物旅游资源精粹的山西为例,通过分析山西文物旅游资源的现状、特点,山西文物旅游资源保护中存在的问题与启示,结合山西文物旅游资源法律保护制度中具有代表性的《大同市云冈石窟保护管理条例》、《山西省平遥古城保护条例》、《大同古城保护管理条例》、《山西省促进旅游产业发展条例》、《加强五台山风景名胜区保护的决定》进行比较分析,目的是考量和明晰我国以地方性法规为主的文物旅游资源法律保护制度体系的现状。第三部分是我国文物旅游资源法律保护制度的完善。通过对我国文物旅游资源中的核心组成部分-世界文化遗产保护的现状分析、存在的问题,我国地方文物旅游资源法律保护制度的局限性分析,意大利、日本、联合国对文物旅游资源法律保护制度的辨析和对我国旅游资源法律保护制度构建的启示,提出我国文物旅游资源法律保护制度完善的建议:其中包括构建《中华人民共和国文物旅游资源保护法》,加强《文物旅游资源保护法》宏观调控制度的建设,设定政府主导的制度体系,强化公民文物旅游资源保护的意识,采取多种方式筹集保护资金,奠定文物旅游资源法律保护的经济基础,建立独立的政府监管机构,规范文物旅游资源多元化的经营模式,构建《文物旅游资源保护法》的立法、守法和执法制度体系,制定违反《文物旅游资源保护法》的责任制度体系,确立诉讼制度、建立独立的执法机构,强化文物旅游资源的系统法律保护、完善相关部门法,加强对地方文物旅游资源法律保护制度的指导。更多还原

【Abstract】 With the development of tourist industry of our country, the civilized histories of several thousand years of Chinese nation, have pregnant with a large number of historical relic tourist resources with national characters in our country. The development of the historical relic tourist industry, make the protection question in the development and utilization of resources of the travel of the historical relic show especially. In view of the current situation of the historical relic tourist resources legal protection at present in our country, this text make an all-round way analyze and study for the legal protection in development and utilization of historical relic travel resources which under the market economy based on public ownership of our country, and the purpose is to improve the system of the historical relic tourist resources legal protection of our country, and to strengthen the protection of the historical relic tourist resources, realize the sustainable development of the historical relic tourist resources.The article is made up of three parts in the structure. Part one is mainly analysis and proving the basic theories of the historical relic tourist resources legal protection in our country. According to differentiating the concept and characteristic of historical relic tourist resources and analyzing it’s importance of society, economy and history in legal protection, we know that, under the theory guidance of recycle economy, our legal protection system of the historical relic and tourist resources should pay attention to setting up the planning system of putting prevention first and controlling in the whole course, we should also implement the system of clean production of the historical relic and tourist resources and make the protection system which accords with the ecological law, so as to ensure the realization of the historical relic tourist resources legal protection system’s value goal.Part two make Shanxi which has the essence of the historical relic tourist resources as an example, through analyzing the current situations, characteristics of the historical relic tourist resources in Shanxi, and problems and enlightenments that existed in the protection of resources, combine it’s representative regulations in the legal protection system to carry on comparative analysis, and consider and the distinct the current situation of historical relic tourist resources legal protection system relying mainly on local regulation of our country in purpose.Part three is the completion of the legal protection system of historical relic tourist resources in our country. According to current situation analysis and existing problem for the protection of world cultural heritage that is the key component in the historical relic tourist resources in our country, and through the limitation analysis of the local legal protection system of tourist and historical relic resource, differentiating and analyzing the legal protection system for tourist and historical relic resources as Italy, Japanese and the United Nations, we propose the suggestion of completion of the legal protection system in our country as follows: Constructing " the law of protection of resources of historical relic travel of the People’s Republic of China ", establish government’s leading system, strengthen the citizen’s consciousness of protection for resources of historical relic travel, take many ways to raise the protecting fund, set up independent government regulator, standardize the pluralistic management mode of tourist resources of the historical relic, make the responsibility system of violating " law of protection of resources of travel of the historical relic ", establish the lawsuit system of public service, set up independent law enforcement agency, improve the law of relevant departments, and strengthen the guidance of the local legal protection system of tourist resources of historical relic.更多还原
