【摘要】 在我国,土地对于农民来说具有多重功能,既是生产资料,又是农村社会保障的载体。然而城市化进程的加速使农民面临因征地而失去土地的危险,土地征收制度的不完善加剧了被征地农民权益的损害,他们沦落为“种田无地、上班无岗、低保无份”的“三无”人员。农民失地又得不到妥善的安置将会危及到社会的稳定。尽管新颁布的《物权法》对土地征收制度作出了新的规定,但是对被征地农民的保护仍显不足,需要相配套制度进一步予以完善。形势所迫,压力所迫,中国土地征收制度的改革如箭在弦上,不得不发。本文旨在通过考察国外土地征收制度,对其理论与实践进行分析,总结其优长,以期阐明我国土地征收制度中存在的问题,分析原因、以尽快完善我国土地征收制度。文章首先是对国外土地征收制度的考察,主要是通过对英国、法国、德国、日本及韩国这几个土地征收法律规定较完备的国家予以介绍,从中得到一些启示,以利于我国土地征收制度的借鉴。然后是对我国土地征收制度的现状进行分析,对我国土地征收制度的内容作了全面的介绍,集中分析和探讨了该制度存在的弊端及其原因。最后是通过制定《土地征收法》、明确公共利益范围、严格土地征收程序、科学制定土地征收补偿机制以及对被征地农民予以司法援助等几个方面来完善我国的土地征收制度。更多还原

【Abstract】 In China, land has multiple functions for peasants: On one hand, it is the means for production; on the other hand, it is the important means livelihood. With the development of city, rural land will be occupied by city, peasants will lose their land because of land expiration. Disadvantages appeared in Land Expiration System made more and more peasants lose in hot water. They are falling low to these persons with no-farming, no-working, no-social security. Peasants loses the land also not to be able to obtain the properly placement, Will be able to endanger to society’s stability. Although promulgated "Reality of laws" to make the new stipulation, but to is drafted farmer’s protection still to reveal the insufficiency, needs the necessary system further to give to consummate. Because of the present situation and the pressure mentioned above, China Land Expiration System becomes increasingly imperative.This article is for the purpose of through the inspection overseas land expiration system, carries on the analysis to its theory and the practice, summarizes superiorly its long, by the time expounded in our country land expiration system exists the question, the analysis reason by consummates our country land expiration system as soon as possible. The paper divides into three parts. The first part is to the overseas land expiration system inspection, mainly is through to English, French, German, Japanese and the South Korean these land expiration legal rule complete country about the land expiration goal, the procedure, compensates three aspects the introductions, obtains some enlightenment, this is of great help regarding our country land expiration system comparison and the model. The second part is carries on the analysis to our country land expiration system present situation, first has made the comprehensive introduction to our country land expiration system content, then the centralism analyzed and has discussed this system existence malpractice and the reason. The third part is through formulates "Land Expiration Law", is clear about the public interest scope, the strict land expiration procedure, the science formulation land expiration compensation mechanism as well as sets up the judicial aid and so on several aspects to consummate our country’s land expiration system.更多还原
