【摘要】 对于不动产善意取得制度的设立，各国的立法态度迥异，而我国对此更是聚讼纷纭。本文从不动产善意取得的历史渊源、社会背景、价值分析等多个角度，结合司法实践，对不动产善意取得制度进行全方位、深程度的阐述，试图构建出完善的不动产善意取得制度体系，以期对我国物权法、民法典的早日出台，摇旗呐喊。全文除导言、结语以外，分四部分论述，共计四万余字。导言。该部分主要阐述本文课题的学术地位和研究的必要性。第一部分不动产善意取得之基础理论。从不动产与善意取得的概念入手，结合各国关于不动产范围的立法划定及善意取得制度渊源，对不动产善意取得的逻辑基点与法律价值，进行全面剖析，展现不动产善意取得的最根本内涵。第二部分不动产善意取得的构成要件及法律效果。通过不动产善意取得内部构成、适用条件、法律效果的详尽阐述，对不动产善意取得进行全方位探究。第三部分两大法系的不动产善意取得制度设立之比较分析。以英、美、德、日、法等国立法为比较对象，分析不动产善意取得制度设立背后的原因。第四部分我国不动产善意取得制度的科学构建。通过对当前法律制度、社会经济、历史人文的分析，论述设立不动产善意取得制度的应然性。集中介绍我国目前关于善意取得及不动产善意取得的法律规定、司法解释，并以物权法草案为基点，结合司法实践，构建完善的不动产善意取得制度体系。结语。本文总结。更多还原

【Abstract】 For establishing system of the bona fide acquisition of real estate, the lawmaking attitudes of any countries are entirely different, opinions differ widely in our country especially. Based on the history origin, social background, worth analysis and many points of view, this paper sets forth on the bona fide acquisition of real estate system comprehensively and deeply, trying to build one perfect system of the bona fide acquisition of real estate, and it can contribute to our country’s law enforcement of the property right law and civil law.This paper has been divided into four parts ,except the introduction and conclusion .it has more than 40,000 words.Introduction. The scholastic position and importance of researching have been elaborated in this part.The first part is the basic theory of the bona fide acquisition of real estate. In this part, the paper introduces the concept of the bona fide acquisition of real estate firstly, combining the legislating designation on the real estate’s scopes in all countries and the system origin of bona fide acquisition, analyzes completely on the logical basic point and legal value of the bona fide acquisition of real estate, and then emerges its cardinal intension.The second part is the composing important items and law results of the bona fide acquisition of real estate. Through illustrating the inner composing, suitable condition and law results of the bona fide acquisition of real estate detailed, this paper carries on the all-directions investigation to the bona fide acquisition of real estate.The third part is the comparing analysis on establishing the bona fide acquisition of real estate system between property right law and civil law. Regarding the legislation of Britain, America, German, Japan and many other countries as the compared objects, this paper analyzes the background reasons of the bona fide acquisition of real estate system.The forth part is the scientific establishment of the bona fide acquisition of real estate system in our country. Through the analysis to the current law system, society economy and history humanity, it discusses the certainty to establish the bona fide acquisition of real estate system. This paper concentrates on introducing the law and judicial interpretation of the bona fide acquisition and the bona fide acquisition of real estate in our country, also, based on the property draft, combining judicial practice, then it builds one perfect system of the bona fide acquisition of real estate.
