【摘要】 信息资源建设是全文数据库建设的基础，版权问题则是全文数据库信息资源建设中的最关键、最基础的问题。近几年来，国内外发生多起有关全文数据库信息资源建设中的版权纠纷和诉讼。因此，研究全文数据库信息资源建设中的版权问题具有重要的理论意义和实践意义。文章介绍了国外和国内全文数据库发展现状，论述了信息资源建设中的版权问题对全文数据库发展的影响，分析了全文数据库信息资源建设中的版权问题及其成因，探讨了全文数据库商的法律地位及其版权侵权归责原则问题，对图书、期刊等八种作品类型全文数据库的版权归属作了具体的分析，提出全文数据库商应当在法律性原则、经济性原则、利益平衡原则和开放共享原则的基础上解决信息资源建设中的版权问题，系统分析了授权许可、法定许可、默示许可和开放共享等全文数据库商可利用的版权使用模式，并提出解决全文数据库信息资源建设中的版权问题的策略，认为必须通过法律、经济和技术三个方面综合起来解决全文数据库信息资源建设中的版权问题。法律手段体现在四方面：开展版权评价工作，处理好与在先权利人的版权关系，加强与著作权人和出版商的合作，参与制订、修改有关的法律法规条例。经济手段体现在二方面：采用灵活、多样的付酬方法，建立通畅、简易的支付机制。技术手段体现在二方面：推行数字版权保护技术，应用先进的浏览软件。更多还原

【Abstract】 Information resource is the foundation for Full-database construction, and copyright issue is the most crucial and the most basic questions in information resource construction. In recent years, the number of Full-database copyright dispute and litigation has been growing, and most of them have relation with copyright problems in information resource construction of Full-database seriously. Therefore, the study on copyright problems in information resource construction of Full-database has strong theoretical and practical significance. This paper introduces Full-database actualities in foreign and domestic, expounds effect that copyright problems in information resource construction have on Full-database development, analyzes systematic copyright problems in information resource construction of Full-database and its causes, discusses legal status and copyright infringement liability principle of Full-database suppliers, holds that Full-database suppliers are the provision of services completely and they should assume strict liability and analyzes specifically problems of copyright attribution in books, journals, newspapers, graduate theses, conference papers, yearbooks and standards Full-database. The author suggests that Full-database suppliers should follow some principles such aspects as legal, economic, benefit balancing and open-share in order to solve copyright problems in information resources construction and puts forward some models that Full-database suppliers should carry out to solve copyright problems, analyzes the characteristic of the models from aspects such as permission, statutory license, conclusion of tacit acceptance and open sharing. The paper puts forward synthetic strategies through the legal, economic and technical tactics that Full-database suppliers should carry out to solve copyright problems. The legal tactics embody such aspects as conducting copyright evaluation, handling well the copyright relations with the first right owner, strengthening cooperation with the publishers and creators, and participating in the formulation and revision of relevant laws and regulations. The economic tactics embody such aspects as performing flexible and diverse pay means, and creating smoother and easier payment mechanisms.
