电子提单功能探析

【摘要】 在航运业和国际贸易领域,随着计算机技术及信息通讯技术的发展,传统提单已经越来越难以适应行业发展的需要,电子提单应运而生,并在实践中迅速发展。同时许多国家和国际组织也制定了相关的法律来规范和支持电子提单的发展。但不可否认的是,电子提单的发展也面临不少障碍。众所周知,传统提单具有运输合同证明、货物收据和物权凭证三大功能,以及由此而派生出来的证据功能。因此,电子提单要取代传统提单,关键是看其是否具备这四种功能。本文共分五章,约三万七千字。第一章是对电子提单的概述。主要介绍了电子提单的定义、种类、法律性质、产生背景和优势、相关立法及在实践中的应用,并阐明了电子提单对传统提单功能的继承和发展。第二章是对电子提单具有货物收据功能的阐述。笔者在介绍传统提单货物收据功能的基础上,阐明了电子提单实现货物收据功能的可行性,并针对电子提单在实现货物收据功能时所面临的障碍提出了相应的解决措施。第三章笔者在介绍传统提单运输合同证明功能的基础上,阐明了电子提单同样具有运输合同证明的功能,并针对电子提单在实现运输合同证明功能时所面临的障碍提出了相应的解决措施。第四章是对电子提单具有物权凭证功能的阐述。笔者在介绍传统提单物权凭证功能的基础上,阐明了电子提单实现物权凭证功能的可行性,并针对电子提单在实现物权凭证功能时所面临的障碍提出了相应的解决措施。第五章笔者在介绍电子提单证据效力的可行性以及电子提单证据属性的基础上,针对电子提单在实现证据功能时所面临的一些问题,从法律角度进行了探讨。结语笔者展望了电子提单的未来,以期能够为我国电子提单的立法和实践提供一些有益的经验和借鉴。更多还原

【Abstract】 At the shipping industry and the international trade realm, along with the development of the calculator technique and the information communicating technique, the traditional bill of lading can adapt the demand of the professional development less and less, so the electronic bill of lading emerges with the tide of the times, and develops quickly in the fulfillment, many nations and international organizations also draw up related laws to standardize and support the development of electronic bill of lading in the meantime. Otherwise, the development of the electronics bill of lading also faces numorous obstacles. As we all know, the traditional bill of lading has three functions: the transport contract certification, the goods receipt and the real right certification, and the proof function deriving from the former three functions. Therefore, if the electronic bill of lading wants to replace the traditional bill of lading, the key is whether it has these four functions or not.This text is divided into totally five chapters, and has about 37,000 words.Chapter one says all to the electronic bill of lading. The chapter mainly introduces the definition, category, law property, the creation background and advantage, relating legislation and the application in the fulfillment of the electronic bill of lading, and clarifies that the functions of the electronic bill of lading inherits and develops the functions of the traditional bill of lading.Chapter two elaborates that the electronic bill of lading has the goods receipt function. On the basis of introducing the goods receipt function of the traditional bill of lading, the writer clarifies the feasibility of the electronic bill of lading carring out the goods receipt function, and puts forward corresponding measures to solve the obstacles that the electronic bill of lading faces to while it carries out the goods receipt function.Chapter three: On the basis of introducing the transport contract certification function of the traditional bill of lading, the writer clarifies that the electronic bill of lading carries out the goods receipt function samely, and puts forward corresponding measures to solve the obstacles that the electronic bill of lading faces to while it carries out the transport contract certification function.Chapter four elaborates that the electronic bill of lading has the real right certificate function. On the basis of introducing the real right certificate function of the traditional bill of lading, the writer clarifies the feasibility of the electronic bill of lading carring out the real right certificate function, and puts forward corresponding measures to solve the obstacles that the electronic bill of lading faces to while it carries out the real right certificate function.Chapter five: On the basis of introducing the feasibility of pontency and the attribute of the electronic bill of lading as a proof, the writer puts forward corresponding measures from the law angle to solve some problems while the electronic bill of lading carries out the proff function.Finally, the writer prospects the future of the electronic bill of lading, and wishes it can provide some beneficial experiences and implications to the legslition and the fulfillment of the electronic bill of lading in China.更多还原
