【摘要】 社会的发展带动了人们知识产权意识的提高,作为知识产权三大组成部分之一的著作权,也逐渐为人们所熟知和重视。“尊重著作权、保护著作权”已成为人们的共识。尤其在2001年新修订的《著作权法》颁布实施后,社会各界对著作权的保护更加有法可依。学术期刊社作为编辑、出版作者智力成果的单位,与《著作权法》及著作权保护等问题的紧密联系程度不言而喻。目前我国学术期刊种类齐全、数量众多,但在学术期刊业一片繁荣的同时,学术期刊社侵犯作者著作权;作者剽窃抄袭他人作品,不遵守约定一稿多投;网络背景下电子期刊侵犯纸质期刊著作权等问题却日渐凸现,影响了学术期刊的正常发展。有鉴于此,本文特在对我国学术期刊著作权保护的现状进行研究的基础上,结合英美等国学术期刊著作权保护的方法和有关国际公约的规定,对学术期刊的概念、权利内容、权利特点等若干重要问题进行了分析研究,提出了以《著作权法》为依托,保护学术期刊著作权,平衡作者、期刊社、使用者三者之间利益的观点,以期能为学术期刊著作权保护提供一些参考。全文除引言和结语外,正文共分六个部分:第一部分:学术期刊概述。前两个问题论述了学术期刊的概念和学术期刊在我国的诞生和发展,是对学术期刊的一个宏观介绍。第三个问题通过对我国学术期刊主体的分析,指出学术期刊这种汇编作品在著作权保护方面不同于一般出版物的最大特点就是著作权的双重性,即整体著作权和局部著作权。第二部分:学术期刊著作权的内容。学术期刊著作权虽然也同一般出版物一样有著作人身权和著作财产权之分。但由于它是汇编作品,所以在著作人身权和著作财产权具体内容和保护方式上又有其自身的特点,不同于一般出版物。本部分主要通过比较学术期刊和一般出版物在著作权内容方面的差别,澄清人们对学术期刊著作人身权和著作财产权的一些错误认识。第三部分:侵犯学术期刊著作权行为分析。本部分主要分析了实践中存在的否认学术期刊整体著作权和局部著作权的错误认识以及常见的侵犯学术期刊著作权,尤其是著作财产权和版式设计权的行为。第四部分:学术期刊著作权保护体制的完善。本部分从三个方面论述了完善这一体制所要做的工作。首先,《著作权法》中对作品使用方式的规定中有一些与学术期刊关系较密切,但这些规定中还存在着一些漏洞,需要改善。其次,签订著作权合同是目前保护学术期刊著作权的一种较好的方法,国外已经大量使用,我国各学术期刊社也应积极采用。最后,强调作者和学术期刊之间互相尊重对方的著作权,有利于学术期刊的健康发展。第五部分:本部分主要介绍了欧美一些著名学术期刊著作权保护的方法以及日本学术期刊著作权保护的政策环境,以期对我国的学术期刊保护能有所借鉴。第六部分:数字化期刊对纸质期刊著作权的侵权与保护。网络技术的飞速发展使数字化期刊对纸质期刊的侵权问题日渐凸现。本部分首先介绍了数字化期刊的概念,然后通过对几年前发生的一起典型的侵权案的分析,提出了网络环境下纸质学术期刊著作权保护的几点建议。最后论述了数字化后期刊著作权究竟该归属何人的问题。更多还原
