【摘要】 受教育权,是当今世界各国公认的基本人权。它既是《世界人权宣言》、《经济、社会和文化权利国际公约》等国际法文件确认和保障的一项重要的公民权利,也是包括我国在内的大多数国家宪法规定的宪法权利。随着社会的进步和生活水平的提高,人们的权利意识越来越强,不仅关心自己是否能够接受基本的教育,而且更加注重获得更多教育机会以及提升受教育的质量,受高等教育权的充分实现成为人们关心的话题。近年来,我国出现了一系列受高等教育权被侵犯的案件。这些案件或是发生在公民争取接受高等教育机会的过程中,或是发生在公民接受高等教育过程中。然而,我国不仅在理论的研究方面滞后而且实务界一直缺乏一套完善而有效的保障机制。这些不足和缺陷使得公民受高等教育权得不到有效的保护和救济。本文通过对受高等教育权基本理论和保障原理的探讨,对世界各国的保障机制进行比较研究,对我国实践现状的诸多问题进行实证分析,力图提出具体的保障救济设想,建构起受高等教育权的保障机制系统。更多还原

【Abstract】 Content: Today, the right to education is recognized one of citizens’ fundamental human rights in worldwide. It is not only affirmed and protected by World Declaration of Human Rights and International Convention on Economy, Sociology and Culture, but also a constitutional right stipulated by most countries, including China. With the progress of society and living level, people have been paying more attention to their rights. People are not only keen to the obtainment of basic education, but also have begun to require more chances to be educated and enhancement of education quality. The realization of the right to higher education has been the focus of people. In recent years, a series cases of violation to the right to higher education happened in china. These cases either happened in the process of people’s application for higher education or happened in the process of people being educated. However, its theoretical study is backward in China, and there is no effective guarantee mechanism in practical field. The backwardness and faultiness result in ineffective protection and relief to the right to higher education. This article, probing into the fundamental theory of the right to higher education and its guarantee principle, comparatively researching into the guarantee mechanism of foreign countries, empirically analyzing the problems in practice, tries to put forward some ideas to optimize the guarantee mechanism for the right to higher education.更多还原
