【摘要】 在中国法制现代化的过程中,中华民族的本源文化永远是其不可或缺并起决定作用的内源力。因此,如何看待自己的传统法律文化,如何实现传统法律文化的创造性转化,是时代赋予我们的重大课题。本文从中国社会主义法制建设的时代需要出发,从当代中国存在的法律文化“二元”结构的冲突切入,运用马克思主义法学原理,首先分析了中国传统法律文化的释义、特征及社会成因,客观地阐述了传统法文化的原貌。因为只有了解传统、理解传统,才能正确地解释传统、更新传统。其次,重点探讨了传统法律文化的当代价值,即找寻传统法律文化中对当代中国社会的进步和发展依然有意义,可以促进中国现代化的成分或因素。最后,对传统法律文化的创造性转化进行了初步的探索。详细分析了创造性转化的涵义、必要性和可能性、动力以及创造性转化的基本途径。更多还原

【Abstract】 In the process of China’s legal system modernization, the Chinese nation culture of origin is indispensable forever and plays a role in determining the source of strength within. Therefore, how to treat self tradition legal culture, and how to realize the traditional legal culture into a creative transformation is the time entrusts with our important issue. This article embark from the need of China socialist legal system construction time, from the contemporary Chinese legal culture of the "dual conflict ", using Marxism legal science principle, analyzed the Chinese traditional legal culture explanation first, the characteristic and the social origin, objectively elaborated the original condition of the traditional legal culture. Because only by knowing the tradition, understanding the tradition, can we interpret the tradition correctly and update the tradition. Secondly, the essay puts great emphasis on exploring the contemporary value of traditional legal culture, that is, the essay tries to find out what factors in traditional law culture will still be of significance to modern society progress and development in china and to the improvement of Chinese modernization. Finally, has carried on the preliminary exploration to the traditional legal culture creative transformation, multi-analyzed the implication, the necessity, the possibility, the impetus and the essential way of the creative transformation.更多还原
