论建筑物区分所有权

【摘要】 建筑物区分所有权制度在西方国家早就以法律的形式予以确认,并有着深厚的理论基础。而我国对其研究尚处在初期。因此,对其进行系统研究,以便健全我国的民法制度和更好地保障公民权利,实属必要。结合中外关于该制度的立法和理论,建筑物区分所有权的性质应是一项复合型不动产所有权,其以三元论说作为对其内容的界定,即建筑物区分所有权是包含专有权、共有权和成员权在内的一项权利。专有部分和共有部分的范围要结合建筑物的特点以及实际情况来确定。在行使权利和提供权利救济时,总体上应遵循传统的所有权理论,但又因建筑物的特殊性而有所不同。这一制度设想应有助于我国该制度的理论发展和立法完善、有助于对我国公民权利的保护。

【Abstract】 The system of Ownership of Apartment Building has been approved by the law long before in the western countries and it has deep-rooted theoretical basis. But the study of it is still at the first stage in our country. Therefore, it is necessary to take a systematic study into it to perfect the Civil Law of our country and better protect the civil rights. Considering the relevant prescription and theories on this system in China and other countries, the ownership of apartment building is a compound real estate ownership. If defined by the Trinity Theory, it is a right composed of the exclusive right, the co-ownership and the ownership. The characteristics and condition of the building should be taken into consideration while deciding the range of the co-ownership while exercising the rights and offering relief of rights, but it’s different because of the special characteristics of buildings. This conception of the system should contribute to the theoretical development of the system in our country and the legislative improvement and to the protection of civil rights in our country.
