网络环境下著作权中的精神权利保护研究

【摘要】 互联网不仅创造了新的作品形式,也使得本就处于无形状态的智力成果变得更加难以控制。更为严峻的是,在网络环境下,版权人的作品可以被随意组合、增删、移位,每个人都有可能不留任何痕迹地改动网络上作品的颜色、形状、排列、署名。网络环境下,精神权利面临着抉择。互联网上到底还有没有精神权利的位置?如何在保护著作权人的精神权利与繁荣网络作品传播这对相互矛盾的问题中找到平衡基点,成为摆在众多法律工作者面前的重要课题。本文将以利益平衡机制为核心,立足从传统著作权中的精神权利保护问题入手,旨在找到与网络环境相适应的、充分协调各方利益的精神权利保护措施,以达到既保护著作权人利益又有效促进网络产业发展,保障公共利益的目的。更多还原

【Abstract】 Internet not only create new works pattern, but also it is very hard to control invisible intellectual products. Under internet environment, copyrights holder’s works may be constituted, deleted, shifted as well. Everybody can change works’colour, symbol, arrangement, signature without any mark. What is the position of spirit rights under internet environment? It is an important problem put forward in front of legal stuff. that we should find a balance point of contradiction between protecting author’s spiritual right and flourishing internet works right spread.This thesis regards value balance system as core part, set foot on spiritual rights protection from traditional works so as to find protection measurement, guarantee the public benefits of spiritual rights which will be adaptable.
