银行监管法律制度研究

【摘要】 金融是现代市场经济的核心,而银行业在一国金融体系中更是占有举足轻重的地位,它的稳定兴衰直接影响着一国乃至国际的经济发展状况。随着经济全球化时代的到来,金融全球化、自由化随之而来。因此,作为金融体系的核心——银行的改革与有效的监管就显得更为重要。如何提高银行防御风险的能力,保护存款人、投资人及社会利益、国家利益成为我国银行监管工作的头等大事。本文从银行监管的基本理论出发,通过对美、英、日等发达国家银行监管法律制度的考察,针对我国银行监管法律体系存在的问题进行了分析,并且提出了相应的完善对策。更多还原

【Abstract】 Finance is core of market economy, and banking is an important part of financial system, the stable or rise and fall of banking influence on an country even international economic development. Fallow the coming period of economic globalization , finance globalization an liberalization also coming. So, banking as the core of financial system have to pay more attention to reform and supervision. The main tasks of banking supervision are improving the ability of resist of risks, protect the benefit of depositor and investor, including social benefit. This article base on the theory of banking supervision, by the research of the banking supervision legal system in the developed country such as American, English, japan, analyzing the problem of banking supervision legal system in our country, then propose adaptive and perfect suggestion.更多还原
