信息网络传播权研究

【摘要】 随着信息网络的飞速发展，通过信息网络传播、获取、使用作品(表演或录音录像制品)越来越频繁，信息网络传播权侵权现象也日益突出。信息网络传播权作为一种新的独立的著作权，如何对它的概念、内涵进行明确界定，直接影响信息网络传播权的立法，并最终影响对该权利的保护和限制。本文首先从国内外对信息网络传播权的定义出发，通过对比研究信息网络传播权与其他相关著作权的关系，对信息网络传播权这一新的著作权的概念进行界定。作为一项新的著作权利，同对其他的著作权利一样，对信息网络传播权的保护与限制是不可偏废的两个方面，因此，本文在对信息网络传播权的概念做出界定的基础上，从信息网络传播权的保护和限制两个方面，以我国当前信息网络传播权立法、权利保护和权利限制为主要研究对象，与国外的信息网络传播权立法、权利保护和权利限制作对比研究，对我国当前的信息网络传播权的立法、保护及其限制等问题做一些初步的探究，在此基础上，提出了几点建议。更多还原

【Abstract】 With the rapid development of information network, Dissemination of information through the network, acquire, use of the work (perforation or recorded video products) have become more and more frequent, disseminating right on information network has been increasingly violated, Dissemination right on information network as a new independent copyright, how to define the concept and contains of it clearly will impact on the dissemination of legislative information network directly, And impact on the protection and restrictions of the rights ultimately, In this paper, from the definition of domestic and foreign dissemination right on information network, and through comparative study of the relationship with other relevant copyright to define the concept of this new copyright, as a new copyright, like other copyright, both the protection and of limitations of the right is essential, Therefore, in this paper, on the basis of defining the concept of information network dissemination right. from both limitation and protection of the right, taking the current legislation、protection and limitation information network dissemination right as a main investigate subject, and compare it with foreign countries, proposed several suggestions on our country current legislation, protection and the limitation of information network dissemination right.更多还原
