【摘要】 2001年颁布实行的新婚姻法首次在我国婚婚法中确立了损害赔偿制度，这无疑更加完善了婚姻法中的救济制度。虽然损害赔偿制度在新婚姻法中的阐述只有寮寮数十字，但它的意义却是十分深远的，充分体现了法律对夫妻中受害方的保护及终极关怀。但在该项救济制度运行及司法操作的过程中，我国婚姻法损害赔偿制度中的一些具体问题也日益凸显出来。基于此，本文从以下几个方面对对婚姻法中的损害制度进行了探讨。首先，本文从法学界对损害赔偿的概念及性质的不同主张入手，通过对这些主张的推敲，总结了自己对于损害赔偿概念的观点，并讨论了损害赔偿在民法中的分类及损害赔偿的四大赔偿原则。其次，本文讨论了婚姻法中引入损害赔偿制度的现实意义。通过一些中外历史资料的研究及对各国婚姻法中损害赔偿制度的总结归纳，阐述了婚姻法中损害赔偿制度的历史演进过程以及我国出台婚姻法损害赔偿制度的现实背景及现状。接下来，本文就目前法学界争论不休的问题，“我国究竟要不要设立配偶权”问题给出了自己的观点，同时对应该设立配偶权所包含的具体内容给出了界定。在此基础上，本文对婚约解除时的损害赔偿，婚姻关系存续期间的损害赔偿，及离婚时的损害赔偿问题进行了逐一讨论，并利用一些具有典型意义的案例来说明这三个不同阶段的损害赔偿在我国婚姻法中的现状及存在问题。并针对我国法律例来对精神损害赔偿的不重视，特别就婚姻法中的精神损害赔偿作为单独一节进行了探讨。最后就婚姻法中损害赔偿制度所出现的问题与不足提出了自己的见解与一些具体的建议。更多还原

【Abstract】 Damage compensation was stipulated by the amendment of the Marriage Law in 2001. The brand-new system absolutely improves the relief system in our Marriage Law. Although the exposition of damage compensation has just a few words , its significance is far-reaching. It shows the law’s protection to the victim of the couple. But in the process of utilizing it and legal practising, some detailed problems in damage compensation gradually appeared. Based on these, the essay discusses the system of damage compensation in Marriage Law. It includes four parts.Firstly, the essay analyses some different pointviews about the concept and natures of damage compensation, and summarizes the author’s pointview to the concept of damage compensation .Then the essay discusses the classification of damage compensation in civil law and four compensation principles.Secondly, the essay analyses the realistic significance in utilizing damage compensation in Marriage Law. According to summarizing domestic and foreign historical damage compensation data in Marriage Law, the essay explains the historical process of damage compensation in Marriage Law. It also analyses the realistic background and the present situation about marriage damage compensation in our country.Thirdly, the essay gives its pointview about the question" Should consortium be established in our country?", which is discussed a lot in the law at present. The essay’s answer is " yes" and it prescribes the detailed contents of consortium. Based on these, the essay discusses the damage compensation in renouncing an engagement, the period of marriage existing and divorce respectively. The essay uses some typical cases to analyse the present situation and the existing problems in three periods of damage compensation. The essay also discusses mental damage compensation as one section because mental damage compensation is usually not valued in our present law.Finally, the essay points out some pointviews and advice to damage compensation in Marriage Law.更多还原
