民族自治地方财政自治权研究

【摘要】 在中国，民族区域自治是指在国家的统一领导下，各少数民族聚居地方实行区域自治，设立自治机关，行使自治权。实践证明，在国家统一领导下实行民族区域自治，符合我国的国情和各族人民的根本利益，具有强大的生命力。民族自治地方财政自治权是《宪法》和《民族区域自治法》赋予民族自治地方自主管理和发展本地区财政的一项法定的权利。民族自治地方财政自治权是民族地区自治权不可或缺的重要组成部分，是民族区域自治制度存在和发展的经济基础。财政自治权能否充分地落实和实施，直接关系到民族自治地方其他自治权能否有坚实的物质基础。离开了财政的保障，其他自治权的落实也很难实现。落实和保障好财政自治权，对于推进我国民族区域自治建设，完善分税制财政体制，合理调整中央和地方关系，促进西部大开发战略的平稳实施和地区经济的合理布局与协调发展，实现各民族的全面振兴和共同繁荣，都有着重要的理论价值和现实意义。新中国成立以后，特别是改革开放以来，民族自治地方的各族人民，在国家和发达地区的大力帮助和支援下，发挥自身优势，自力更生，奋发图强，不断增强自我发展能力。经过50多年的努力，如今中国民族自治地方的各族人民，生存和生活环境明显改善，经济和社会事业迅速发展。财政自治权在民族自治地方实施以来，民族经济得到了长足的发展，民族地区财政也有了显著的增加。但民族地区财政自治权的实施仍然存在着许多问题，困扰着民族地区财政自治权的落实。西部大开发战略的实施和“十一五”规划发展纲要的提出，对完善民族自治地方财政自治权提出了更高的要求。按照公共服务均等化原则，加大国家对欠发达地区的支持力度，对民族自治地方逐步提供均等的公共服务，为研究民族自治地方财政自治权，提出了新的课题。必须进一步研究如何落实财政自治权，完善民族自治地方的财政转移支付制度，以期完成西部大开发战略和“十一五”规划发展纲要的要求。本论文在借鉴国内外研究“中国民族自治地方财政自治权”相关研究成果的基础上，阐述了民族自治地方财政自治权的基本理论，剖析了民族自治地方财政自治权发展的现状，指出了当前民族地方财政自治权实施存在的主要问题，分析了制约财政自治权落实的主要因素，并据此从以下三个方面提出了完善民族自治地方财政自治权具体建议：一、落实民族自治地方财政自治权的对策。着重从政策和法律方面来提出建议。二、完善财政转移支付制度的对策。从转移支付模式的优化、框架的构建、分配方式的规范等方面来阐述建立科学规范的财政转移支付制度。三、设立专用资金和民族工作经费的对策。民族自治地方财政的特殊性决定了中央要设立各项专用资金和民族工作经费来扶助民族自治地方的发展。更多还原

【Abstract】 In China, Regional national autonomy means that the minority nationalities, under unified state leadership, practice regional autonomy in areas where they live in concentrated communities and set up organs of self-government for the exercise of the power of autonomy. Regional national autonomy embodies the state’s foll respect for and guarantee of the right of the minority nationalities to administer their internal affairs and its adherence to the principle of equality, unity and common prosperity for all its nationalities.The organs of self-government of national autonomous areas shall have the power of autonomy in administering the finances of their areas. Financial autonomy has played an enormous role in giving foll play to national autonomies. It is the economic basis of regional national autonomy. Without the guarantee of finance, any other autonomy will not easily be realized.With the reform and open system, people in national autonomous areas have made great achievement under state’s support. But there are still many problems in practicing financial autonomy. According to the requirement of Development in Western China, the state should gradually support the equal common services to all the regions. It gives us a new topic on research of financial autonomy.This thesis introduces the basic theory on financial autonomy,analyses the actuality of implementing financial autonomy, points the main problems, and finally concludes the advice for improving national financial autonomy.更多还原
