【摘要】 家庭承包制的推行使土地保障在回归的基础上得到强化，其复位不仅是农户克服生存压力的集体回应，而且承载着农民对公平的诉求。在完成释放家庭承包制制度绩效的历史使命之后，土地保障削弱了家庭承包制演进的路径依赖，成为农村经济发展的桎梏。随着产业结构的调整以及非农产业的迅速发展，农业经营比较收益下降，非农收入占农民收入的比重不断攀升，导致土地保障不断弱化。“虚化”的土地保障是引发土地频繁调整，阻滞农地适度规模经营，抑制农地使用权流转以及牺牲农地生产效率的肇因，不仅彰显出新型农地使用制度形态的缺陷，而且严重制约农地产权制度改革，因此，弱化土地保障成为改革现行农地产权制度不容回避的问题。结合弱化土地保障推进农地产权制度改革，须破除均田承包的传统模式，以农地使用权流转取代土地行政性调整，引导农户从短期经营向长期投入转变，实现农村剩余劳动力向非农产业的顺利转移。推行并完善农地股份合作制无疑是弱化土地保障改革农地产权制度的有益尝试和探索。本文以弱化土地保障为视角，在阐述现行农地产权制度与土地保障关系的基础上，分析了弱化土地保障改革农地产权制度的可能性及必要性，并提出通过完善农地股份合作制实现农地产权制度改革的顺利推进。更多还原

【Abstract】 The implement of household contract responsibility system resumed and strengthened the land security system, which is not only the farmers’ group feedback towards the survival stress but also shows farmers’ appeal for justice. After the accomplishment of the historic task to release the system performance of household contract responsibility system, the land security system weakened the path dependence of the household contract responsibility system, and thus became the shackle of the rural economy. With the restructuring of industries and the rapid development of non-agricultural industries, the comparative profits of agriculture decreased while the proportion of non-agricultural incomes increased, which has led to the continuous weakening of the land security system. The weakened land security system reveals the defects of the new farmland use system and seriously restricts the farmland property right system reform and innovation, as it causes frequent farmland adjustment, hinders the moderate scale management of farmland, restrains the circulating of farmland management power, and reduces the productivity of the farmland. Therefore, it can’t be avoided to solve the problem of the weakened land security system.To promote the farmland property right system reform and innovation in combination with the weakened land security system, we should abandon the traditional contract mode based on equalized farmland, make the transference of the farmland use right replace farmland administrative adjustment, guide farmers to turn from short-term management to long-term investment, and help surplus farm labors relocated in non-agricultural industries. Implementing and improving the farmland stock cooperation system are undoubtedly a valuable attempt to weaken the land security system and reform the farmland property right system. Taking a perspective of land security system, this dissertation analyzes the possibility and necessity of weakening the land security system and reforming the farmland property right system based on the relationship between current farmland property right system and land security system, and puts forward a suggestion that the farmland stock cooperation system is an effective way to achieve the successful farmland property right system reform and innovation.更多还原
