【摘要】 随着技术的日趋完善与网际经济的蓬勃发展，人类社会已经迈进一个全新的电子化时代，传统以书面文件及签名、盖章来确认相关权利、义务的通信与交易行为，已逐渐被电子文件与电子签章所取代。然而在虚拟的电子网络中潜伏着许多不安全的因素，例如网路安全的规范，电子交易或电子文件传送过程的风险亦很在所难避免，但如何将风险降到最低，在法律上如何保障网络中安全通讯及交易，正极待探讨的问题。 有鉴于近年“数位签章”或“电子签章”技术于各国具是热门话题，是目前被认为是保护合法网络使用者最有效的方法。文章就电子商务近年发展，以及台湾地区近年关于电子签章立法的过程，不同立法草案内容的变化，从1997年开始草拟数字签章法，然后是1998年、1999年及2000年的草案，可见随着国际社会及当地对数字签章及电子签章技术的认识增加，在立法的研究和讨论过程中不断寻找适合台湾地区的《电子签章法》。 本文针对台湾《电子签章法》立法目的，透过赋予电子文件和电子签章的法律效力，探讨建立可信赖的网路交易环境，确保能够掌握某一资讯在网路传输过程中，是否遭到伪造、窜改或窃取，识别交易双方身分，防止事后否认已完成交易的事实，以保障资讯正确与完整性。最后进一步探讨凭证机构的作用，及电子签章对其它产业可能带来的影响与冲击。期望对我国今后立法有参考价值。更多还原

【Abstract】 With the perfection and vigorous development of technology, human society has stepped into the brand new era of electronics. Traditional written documents, autographs and signature, which used to be commonly used for confirming rights and responsibilities as well as transactions, have been gradually replaced by electronic documents and electronic signature. However, there are some hidden unsafe factors in the virtual cyber space, such as the regulations for the safety of the internet and the inevitable danger which is caused by the transmission of the electronic deal and electronic documents. How to reduce the risks to minimum and how to protect communications and deals in the virtual cyber space through the law are urgent problems for us to discuss.Recently, the technology of "digital signature" and "electronic signature" has been a quite popular topic all over the world and this technology is viewed as the most effective method to protect legal internet citizens. This dissertation focuses on the recent development of E—business and the legislation of electronic signature in Taiwan area. This dissertation also introduces the changes of different legislation drafts in Taiwan, from the 1997 drafts to the 1998,1999 and 2000 drafts. With the developing understanding of the digital signature and electronic signature, Taiwan has been looking for its own suitable Electronic Signature Act through constant legislative research and discussion.In view of the purpose of Taiwan Electronic Signature Act, this dissertation discusses how to build up a reliable environment for cyber transactions by the means of bestowing electronic documents and electronic signature with legal protection and how to protect the correction and integrity of information by the means of finding out whether some information has been faked, misrepresented or stolen and of identifying every party of the transaction. The last part of this dissertation further discusses the functions of Certification Authority and the influences brought by electronic signature and other related industries, which may be used as reference for China.更多还原
