【摘要】 我国改革开放以后,尤其是市场经济体制的确立,为票据制度的推行和票据立法带来了契机。1996年1月1日《中华人民共和国票据法》的实施,标志着我国票据活动已经进入法制轨道,对我国社会主义市场经济法律体系的形成和发展具有划时代的意义。随着中国市场经济的发展,票据日益成为交易、信用、融资必不可少的工具。然而,现行《中华人民共和国票据法》因诸多因素,存在一些不足和缺憾,特别是我国加入WTO以后,随着国际贸易的迅猛发展,这些不足和缺憾已经成为市场经济和国际贸易发展的障碍;同时,我国法学界对票据立法的研究尤其是对票据法律制度的核心——票据背书法律制度的研究也存在一些不足之处,因此借鉴西方发达国家的先进经验,对票据背书法律制度进行比较全面和深入的研究,意义重大。本文是一篇尝试以比较方法研究票据背书法律制度的理论性论文。本文旨在通过对我国《票据法》和目前世界上存在的两大票据法系即日内瓦法系和英美法系在票据背书法律制度方面的比较研究,以加深对我国《票据法》的理解,从而从中获取关于如何改进和完善我国《票据法》的重要启迪。全文由两部分构成,第一部分,票据背书法律制度的价值分析;第二部分,票据背书法律制度的比较分析与完善。论文第一部分明确了票据背书法律制度的价值目标,即保障交易安全性与交易的迅捷性,进而考虑了英美法系和日内瓦法系票据法关更多还原

【Abstract】 Our country reform is a market economy system to really sign particularly after opening, promoting for the note system with the note lawmaking brought a chance. January 1,1996《the People’s Republic of China note laws》of implement, symbolizing the our country note activity has already got into legal system orbit, to our country formation and development of the law system of the socialism market economy have epoch-making meaning. Along with the development of Chinese market economy, the note becomes the tool of bargain, reputation, margin essential to have increasingly. However, current《the People’s Republic of China note laws》exist some shortage and missing because of many factors, especially our country after joining WTO, along with the fast fierce development of international trade, these obstacles that shortage and missing has already become market economy and international trade development; In the meantime, our country method educational circles to note lawmaking of research particularly is to note law system of the endorsement law of the core-note system of the research also exists some shortage of place, so draw lessons from the advanced experience of western and flourishing nation, to the law system of the note endorsement carry on more overall with thorough of research, meaning graveness.This text is a theories thesis which tries to study the law system of the note endorsement by comparison. This text aim is passing to the our country《note laws》and currently in the world the existent two greatest notes method fasten namely the Genevan method fasten with British and American methods fasten in the comparison research of the law system of the note endorsement to deepen to our country《note laws》of comprehension, obtain how to improve from it thus and perfect our country《note laws》of the importance inspire.更多还原
