空间利用权研究

【摘要】 从罗马法直至现代,人们对土地的利用主要是以平面为主。土地的所有权行使及于土地的上下,土地所有权人享有“上及天宇,下及地心”的绝对权利。然而,随着工业现代化的发展、人口膨胀的加剧和城市化进程的加快,地表资源的有限性使得人们迫切需要对空间进行开发利用。城市中的高架铁路、空中走廊、地下商场等如雨后春笋般涌现。 社会生活的变革必然引起法律的发展。当土地从“平面的开发利用”向“立体的开发利用”转变的时候,19世纪末20世纪初,以地表上下一定范围的空间为客体的空间利用权产生了。空间利用权作为一种新的权利,它的产生为缓解土地资源的匮乏,解决实际中大量存在的空间利用纠纷提供了解决依据。同时,也为空间的开发利用奠定了法律基础。 迄今为至,空间利用权已经被大多数国家的立法、判例所确立。但是,就我国大陆地区而言,空间利用权仍然是一种新的权利,空间利用权的立法刚刚起步。有鉴于此,本文从空间成为物权客体入手,通过参照国外以及我国台湾地区的立法例,探讨空间利用权的物权属性。在此基础上,通过对空间利用权和其他不动产物权的比较,确定空间利用权存在的独立性和实用性。最终,结合上述论证构建适合我国的空间利用权体系,以期借此可以加深人们对空间利用权的法律思考,促进空间权利用权的建立和完善。

【Abstract】 From Roman law times to modern times , the land usage of mankind emphasizes generally the exterior of the earth’s surface .Exercising of land ownership reaches the surface and the underground. However , up to the today with the development of social industrialization, with population expanding and urbanization process speeding up , the limitation of the earth’s surface makes mankind get in urgent need of developing and utilizing space .In the city , the successive appearance of land three dimensional usage such as overhead railway, air corridor, underground market etc.The social life transformation causes the legal development inevitably, when the land transforms from "the plane development use" to "the three-dimensional development use", 19 century’s ends at the beginning of 20th century, the certain scope space produced take the surface about as object spatial usage right. Spatial usage right as one kind of new right, its production alleviates the land resource in deficiency, the solution actual center massive existences space has provided the solution basis using the dispute. At the same time also has laid the legal foundation for the spatial development use.Up to now for to, spatial usage right already by the majority national legislation, the legal precedent is established. But, says in our country land area, spatial usage right still is one kind of new right, the spatial usage right legislation just starts. The taking this into consideration, This article becomes the real right object from the space to obtain, through reference overseas as well as our country Taiwan area vertical legal regulation, discussion space usage right’s real right attribute. In this foundation, through spatial usage right and other real estate real rights comparisons, definites spatial usage right existence independence and usability. Finally, the union above proof constructs suits our country the spatial usage right system, by the time hoped may deepen the people taking advantage of this to ponder to the spatial usage right law, the promotion space right uses the power the establishment and the consummation.
