完善我国著作权集体管理制度的设想

【摘要】 著作权集体管理问题可以说是我国著作权法的研究和实务中的一个关键问题。自1992年我国第一家集体管理机构——中国音乐著作权协会成立以来，著作权集体管理问题即深受关注，但1990年的《著作权法》对此并无规定，1991年的《著作权法实施条例》也只是零星提及。2001年新修订的《著作权法》确立了著作权集体管理的原则。随着2005年《著作权集体管理条例》的出台，中国对著作权集体管理已经纳入到了法律的基本框架之内。但是我国的著作权集体管理的制度，在整体的法律制度、管理组织的建设、社会和百姓的认知态度等方面还存在一系列的问题，有待于进一步的完善。因此，对著作权集体管理问题的研究具有非常重要的理论意义和现实意义。 正文由六章构成： 第二章是对著作权集体管理的概述。论文在分析著作权集体管理的内涵的基础上对作者产生大众化、复制内容完美化、传播渠道网络化、利用需求多元化的著作权集体管理的背景进行了全面的分析。另外对著作权集体管理的自愿性原则、必要的强制性原则、效率原则及垄断性原则和著作权集体管理的作用，分析的也比较全面。 第三章阐述了著作权集体管理组织的成立与性质，分析了著作权集体管理组织与著作权人的关系。世界上第一个著作权集体管理组织是早在1777年法国的艺术家成立的法国戏剧作家作曲家协会(SACD)。中国唯一的著作权集体管理组织是1992年成立的中国音乐著作权协会。著作权集体管理组织是非营利性的官管民办的双重性的组织。 第四章分析了传统著作权集体管理与网络著作权集体管理的内容与区别。适于集体管理的权利包括著作权法规定的表演权、放映权、广播权、出租权、信息网络传播权、复制权等6种权利。新兴的集体管理组织的权利是信息网络传播权和放映权。网络著作权的集体管理在管理内容、管理方式等方面与传统著作权集体管理有很大的区别。 第五章论述了我国《著作权法》与《著作权集体管理条例》中有关著作权集体管理的相关内容；分析了著作权集体管理中存在的不足，并在立法制度、执法制度、政府的主导作用、社会的宣传工作及提高著作权人的维权意识等方面，提出了完善我国著作权集体管理制度的具体建议。 第一章是绪论，是论文的引论部分；第六章是结论部分。更多还原

【Abstract】 The copyright collective management problem may say is a key point in the research and practice of our country copyright law. The first collective management organization - China Music Copyright Association had been established since 1992, the copyright collective management problem have attracted more attention, but " Copyright Law " of 1990 has not stipulated to this, " Implementing Regulations of Copyright Law" of 1991 were just mentioned sporadically." Copyright Law" revised newly in 2001 has established the principle of copyright collective management. With the issue of "Collective Management Rule of the Copyright " of 2005, China has already brought the collective management of the copyright into the basic frame of the law. But the system of collective management of copyright of our country, a series of problems still exist in such aspects as legal system , the construction of the management organization , cognitive attitude of the society and people. So, the study on collective management problem of the copyright has very important theory meaning and realistic meaning。This thesis is formed by four chapters :Chapter One is a summary to collective management of the copyright. On the basis of analyzing intension fo copyright collective mangement, thesis carry on overall analysis on producing popularization to author, duplicate content to be perfect to take , propagate channel to be networked , utilizing demand pluralistic copyright collective background. In addition to copyright collective voluntary principle, essential mandatory principle, efficiency principle and monopoly principle and copyright collective function of management of management, author analysed overall, too.In Chapter Two, the author explained establishment and property of the collective management organization of the copyright, analyzed the relationship of copyright collective management organization and the copyright owner. In the world the first copyright collective management organization is France Drama Artist and Composer Association (SACD ), that is established by France artist in 1777.
