【摘要】 随着高等教育领域中法治理念和个人权利意识的增强,在高校管理体制改革的实践进程不可避免地出现了新旧价值体系之间的矛盾冲突,涉及到高等教育方面的司法诉讼成为人们关注的热点。相形之下,高校内部管理中法权体系的建构与完善也就成为高校管理法治化趋势中的必然面对的核心问题。 本文在论证高校内部管理体制法治化的内涵及其实践机制过程中,首先论证的是高校内部管理法治化的法理基础和实践价值,认为现代高校的管理越来越依赖于一个理性化的运行机制。高校内部管理体制法治化内涵主要地包括理性立法、合法并且合理地行使权力、健全相应的权利救济制度等内容。在现代社会,管理法治化的内涵成为公正的一个重要渊源进而也成为现实秩序的价值基础。因此,管理法治化是现代高校管理中最具时代特征从而也最具实践意义的管理模式。在本课题的研究过程中,不可避免的要就高校办学自主权与政府对高校的管理权限的关系,高等学校与社会投资主体的关系,高校的内涵建设和外延拓展与管理领域法权体系建构的问题进行高校现行管理模式的合理化批判,并就高校内部学术委员会的权力性质及其制约机制,学校与学生在管理活动中产生的法律关系的性质、层次以及对管理权的制约和教育行政救济制度等问题进行初步的分析和探讨,分析高等学校内部管理法治化的迫切需要。最后从高校内部管理关系领域中法律调整机制的完善和法权关系建构的视角,进一步地提出推进我国高校内部管理法治化的几点建议。更多还原

【Abstract】 With the enhancement of the idea of law management and individual rights in the higher education field, the contradiction conflict between the new and old value systems will appear unavoidably in the practice of university’s management system reform. The judicial lawsuit of higher education becomes the focus that people pay close attention to. By contrast, the construction and consummation of university law right system becomes inevitably the core question which a university faces to build in management.In the discussion of the intension of management system ruled by law and practice mechanism in the university, the paper first proves the legal principle foundation and practice value ruled by law inside the university and hold the idea that the management of the modern university depends on a reasonable operating mechanism more and more. Its intension mainly includes legislative rationalization, rational legislation, exercising power legal and reasonably perfecting the right pension system. In modern society, the intension of legal management becomes one important origin and value foundation of realistic order too. So management ruled by law of modern university has the characteristic of the time and has the most important practice. In the research of this subject, the paper will preliminarily carry on university current management mode and criticize rationally the relation of the administration authority to the university of autonomy and unavoidable government of the university, relation between the institution of higher education and social investment subject, intension construction and expansion of university and the problem of the construction of management field right system. At the same time the paper will analyze the power nature and restriction mechanism of the academic committee inside the university, level of legal relation which the school and student produce in management activity, and the question of relieving the system to the restriction of administrative power and educational administration etc. By this way, I will point out the urgent need of law rules inside the institution of higher education management .At last, the paper manages and concerns from the visual angle of the perfection of adjusting the mechanism of the law and the construction of right relation in the field of university and finally puts forward and advances some suggestions of management ruled by law inside the university of our country further.更多还原
