西方发达国家阳光政府的理论实践对我国行政体制改革的启示

【摘要】 阳光政府的概念是伴随政治民主化、公民政治权利觉醒逐步被提出的，成为西方发达国家政府构建的基本理念。笔者在认识到国际社会出现的这一历史趋势的基础上，首先着重分析了西方发达国家阳光政府产生历史背景及发展历程，特别是美国、英围、日本等国家阳光政府的产生过程，在此基础上总结了西方发达国家阳光政府发展的经验教训。其次，笔者具体从阳光政府的公开性、程序性、法治性和参与性四个方面分析其概念内涵，并揭示出阳光政府的宪政理念、理性的哲学基础以及行政透明化的制度基础，对阳光政府的概念实现全面深入的把握。由于阳光政府涉及公民知情权以及政府信息公开两方面的内容，接下来笔者侧重于对阳光政府的受体——公民知情权的具体内涵进行分析，从公民知情权与表达自由、行政参与的关系角度阐明公民知情权的完整内涵，并将公民知情权与政府信息公开之间的博弈关系以准确的语言加以描述。文末笔者着重分析阳光政府在我国的建设情况，在认清我国国情显示的基础上，针对在实现政务公开过程中出现的问题，对出现这一问题的主要原因进行了分析，并提出了相应的政策建议和改进措施，以期对我国阳光政府的构建有所帮助。更多还原

【Abstract】 "Sun Government" came into people’s mind with the democratization of the politics and realization of people’s rights. It become the basic idea for developed country in organizing the government. The writer realizes this trend all over the world, so the text firstly gives a specific analysis of the history of the "Sun Government" in Western developed Countries, especially in United States, England and in Japan, from which we learn both experience and failures. Then we give a deep and comprehensive analysis of the "Sun Government", and on the basis of this, we specifically introduce the "Object and Subject" of the "Sun Government" and the relationship between the two. Finally, from the reality of our government, we talk about the problems we come upon when China build the "Sun Government", and analyze the reason of this phenomenon .At last, we try to give some useful suggestion on how to build an effective , efficient and economic Government.更多还原
