我国政府信息公开研究

【摘要】 在知识经济时代和信息社会中，政府信息公开已成为公众的普遍需求。自20世纪中叶以来，世界各国特别是发达国家，纷纷建立起政府信息公开制度。这既是对公民知情权的尊重，也是经济全球化和政治民主化的必然结果。而回望国内的政府信息公开状况，却并不令人乐观，制度的缺失和观念的落后使得目前我国在政府信息公开中存在诸多问题。随着中国加入WTO，这一问题更加暴露与突出。如何真正履行WTO的透明度原则，满足公民的知情权，促进社会主义市场经济和民主政治的良性发展，成为摆在当代学者面前亟需解决的重要课题之一。 本文共分四个部分。第一部分是基本理论研究，主要阐述政府信息公开的含义并对与其相关的概念进行区分，然后又粗浅论述了政府信息公开的理论基础即知情权理论的含义、性质和宪法依据。第二部分指出了目前我国政府信息公开中存在的诸多问题，并从多个角度剖析造成这些问题的原因。第三部分运用辩证唯物主义的内外因原理，分析了推动我国政府信息公开的动力源泉。其中的内因是从经济、政治、文化和个人生活四个方面来阐述，而外因则主要从WTO的透明度原则角度来论述。第四部分针对我国政府信息公开中存在的问题及产生原因，从宏观和微观两个层面提出促进我国政府信息公开的对策。 政府信息公开是信息时代各国政府的必然选择。由于历史和现实的原因，我国在信息公开制度的建设方面较为落后，但社会现实已经对信息公开提出迫切要求，随着立法工作的不断发展，我国政府信息公开制度的建立指日可待。更多还原

【Abstract】 Opening the governmental information has become a common need of people in knowledge economic era. Countries, especially the developed countries have founded the opening institution of governmental information since the later half of twentieth century. It is the respect to the right to know of people, and also the inevitable result of economy globalized and politics democratized. However, the domestic situation is poor. There are lots of problems in publicity of governmental information Because of the lack of institutions and backward ideas. The problems are more outstanding after the entry of China into WTO. How to thoroughly fulfilling the transparency principle of WTO, realizing the right to know of people, and promoting the excellent development of socialist market economy and democracy politics becoming an urgent and important subject to the modern scholars.The article is composed of four parts. Part one is the research of fundamental theory, the main work is introducing the meaning of the freedom of governmental information, discriminating the difference to the relative concepts, and illustrating the theory of the right to know. The contents of part two is pointing out the problems exist in practice of opening the governmental information in our country, and dissecting the causes result to the consequences from different angles. I analyze the pushing power of opening the governmental information from internal cause and external cause in the third part. Lastly, I put forward some countermeasures corresponding the problems from macro-angle and micro-angle.Opening the governmental information is the inevitable choice of all the democratic governments in information era.
