【摘要】 全文分四章。 第一章：主要探讨污染环境犯罪的概念、污染环境犯罪的范围和污染环境犯罪的分类。 第二章：论述了污染环境犯罪的犯罪构成，这是本文的重点部分。在客体方面提出污染环境犯罪的客体，一方面侵犯了不特定人的生命、健康和公私财产权；另一方面又侵犯了整个人类的生存和发展权。在客观方面界定了污染环境犯罪的危害行为。从分析污染环境犯罪因果关系的特点着手，指出推定污染事实与损害事实之间因果关系的难点，提出采用日本的“流行病医学”为原则并结合我国国情采取相应的措施。在主体上，承认自然人的犯罪主体资格。界定了作为污染环境犯罪主体的单位的范围，并通过分析实务中单位污染环境存在的问题，提出完善单位污染环境犯罪的办法。论述了国家在国际污染环境犯罪中可以成为主体，但在国内污染环境犯罪中，国家不能成为此类罪的主体。在主观方面，分析了污染环境犯罪中存在故意，过失和无过失三种形态，指出在我国污染环境犯罪中没有无过失责任原则存在的余地，即不能适用严格责任。 第三章：从处罚方式和处罚原则两方面论述了污染环境犯罪的刑事责任。在处罚方式方面，应采用刑罚处罚与非刑罚处罚相结合的方式。在刑罚方面，提出扩大自由刑适用范围，提高罚金刑的地位，适用资格刑。对于非刑罚处罚方法，应适宜适用。 第四章：从分析外国关于污染环境犯罪的三种立法模式：综合式、法典式和行政刑法式入手，评析我国现行关于污染环境犯罪立法上的缺陷，提出了完善办法。更多还原

【Abstract】 The paper consists of four parts-introduction.The first chapter generally discusses the conception , range and classify of the crimes of polluting environment.The second chapter discusses the criminal record of the crimes of polluting environment. It is the important part of the paper. On the object, the paper not only put forward the object of this crimes is zoology connection between human and nature. On the impersonality, define the harm action of the crimes of polluting environment, analyze the causality of the crimes of polluting environment, introducing epidemic physic of Japan. On the principal part, define the range of units, advance the country can be the main part of international polluting environment. On the subjective, analyze there are three form in t the crimes of polluting environment: intent, defect and without defect. Consider strict ability can not stay in Chinese crimes of polluting environment.The third chapter discusses the penal ability of the crimes of polluting environment. On the mode of penalty, punishment and no punishment should be take. Advancing widen the range of punishment against freedow. Advance the status to the punishment of fine.The last chapter discusses the lack to the 1997 criminal law on the crimes of polluting environment.
