【摘要】 中国的图书版权贸易作为出版产业中利用国内外资源最有效的手段，经过近二十年的发展，已经取得了巨大的成就。中国加入世界贸易组织，加速了出版行业的国际化进程，图书版权贸易作为出版行业实施国际化战略的突破口，其面临的机遇和挑战是不言而喻的。在新的全球经济一体化的环境中，图书版权贸易如何克服现存的诸多弊端，抓住机遇，迎接挑战，已成为出版领域中日益重要的课题。 本文结合大量的统计数据，采用定量、定性和比较分析的方法对中国图书版权贸易的现状进行了分析，总结了图书版权贸易取得的成绩，指出了其发展过程中的问题，最后提出了新形式下图书版权贸易应采取的应对措施。 全文共分五部分： 第一部分论述了图书版权贸易的基本理论。首先论述了“版权”、“著作权”、“版权贸易”等相关概念，指出版权的特点和内涵，由此引出图书版权贸易的概念：即版权所有人与图书使用人之间，就有偿转移图书之版权中的某项或几项财产权进行的经济活动。然后在此基础上论述了图书版权贸易的主体和客体、进行图书版权贸易应遵循的基本原则、以及图书版权贸易的形式和图书版权贸易的法律保护。 第二部分：从图书版权贸易的业务流程角度探讨了图书版权贸易过程中的准备工作、谈判过程和后期工作三个阶段的具体内容及注意事项。共分为四节：版权信息的获取是开展图书版权贸易的前提；查找真正的版权权利人是开展图书版权贸易的保证；版权合同是图书版权贸易谈判的最终结果，其主要条款是合同的重要组成部分；签约后的工作是确保图书版权贸易获得收益的重要因素。 第三部分：结合大量的统计数据，通过对引进图书和输出图书的分析，详细论述了我国目前图书版权贸易的状况。指出图书版权贸易存在的问题：贸易逆差明显、地区发展不平衡、无序竞争和版权贸易人才缺乏。通过对成绩和问题的研究提出了影响图书版权贸易的因素：经济水平和产业规模、图书商业运作模式、文化背景差异、版权代理和专业人才。 第四部分：讨论了与图书版权贸易紧密相关的四个问题。第一，国际书展。国际书展是开展对外图书版权贸易的有效手段，逐渐被各国出版界重视。主要介绍了五个典型的具有影响力的国际书展。第二，版权代理机构。版权代理机构是开展图书版权贸易的桥梁，在图书版权贸易中发挥着重要的作用。主要论述了版权代理机构的主要业务、工作流程和现状。第三，国际合作出版。分析了国际合作出版与版权贸易的区别。第四，平行进口问题。分析了平行进口在图书版权贸易中的体现。 第五部分:论述了WTO背景下的图书版权贸易。中国加入WTO，市场竞争加剧，不可避免地对图书版权贸易提出了严峻的挑战。这一部分从WTO为图书版权贸易带来的机遇和挑战分析了入世对中国图书版权贸易的影响，最后提出我国出版界的应对策略。更多还原

【Abstract】 Chinese books copyright trade, as a most effective way to use the domestic and foreign resources in publication industry, had already obtained the huge achievement after nearly 20 years development. China joining the World Trade Organization has accelerated the publication profession internationalization advancement. As the breach of internationalization strategy, opportunities and challenges the books copyright trade faces are self-evident. In the new whole world economic integration environment, how does the books copyright trade overcome the extant many malpractices, holds the opportunity, and meets the challenge have been more and more important topics in publication industry.The paper unifies the massive statistical data, uses quantitative, qualitative and comparative analysis methods to describe the Chinese books copyright trade present situation, summarizes the achievement in the books copyright trade, points out the problems in its developing process, and finally proposes the measurement the books copyright trade should adopt in new situation.The paper can be summarized into five parts:The first part elaborates basic theory of books copyright trade. First it analyzes "the copyright", "the works right", "the copyright trade" and so on the correlation concept, points out the characteristic and the connotation of the copyright and draws out the concept of the books copyright trade: Namely the economic activity of several paid copyright shift between copyright owner and books user. Then in the light of these basic concepts, it elaborates the body and the object, the basic principle, the forms and the legal protection of the books copyright trade.The second part discusses the preparatory stage, the negotiations stage and the later period in the books copyright trade process from the angle of works flow. It can be divided into four parts as the following: the gain of the copyright information is the premise of the books copyright trade; Searches of the true right holder is the guarantee of the books copyright trade; The copyright contract is final outcome of the bookscopyright trade negotiations, its main clauses are the important constituent of the contract; The period work after signing a contract is the important attribute to guarantees the income of the books copyright trade.The third part discusses the books copyright trade present situation of our country using the massive statistical data and the analysis of books import and export. It points out the problems of books copyright trade: obvious trade deficit, imbalance of the local development, disorderly competition and lack of copyright trade talented person. It also proposes the factors of influencing the copyright trade by analysis of the problems which are: economical level and industrial scale, books commercial operation pattern, cultural context difference, copyright proxy and specialized talented person.The fourth part discusses four issues closely related to books copyright trade. First is international book exhibition. The international book exhibition is an effective method of foreign books copyright trade development and has gradually been taken by the various countries. This part mainly introduces five typical international book exhibitions. Second is the copyright agency. The copyright agency is the bridge of the books copyright trade development and has played the vital role in the books copyright trade. It mainly elaborates the main service, the service flow and the present situation of the copyright agency. Third is the international cooperation publication, which analyzes the difference of the international cooperation publication and the copyright trade. Fourth is the parallel import, which analyzes the parallel import manifesting in books copyright trade.The fifth part elaborates books copyright trade under the WTO background. As a result of China joining WTO, the market competition intensifies, which inevitably proposes the stern challenge to the books copyright trade.
