【摘要】 刑法是公法，保护社会整体利益是其本质属性；民法是私法，保障市民个体利益是其根本所在。刑法代表权力，民法代表权利，从表面看来，二者蕴涵截然不同，难以相融。然而，在悠远的历史进程中，我们探究到刑法理念与民法理念有契合的地方，即以人为本、注重个人权利保障的民法理念是二者的契合之点；而且，民法理念是刑法的基础理念。民法理念充分而深刻地体现于刑法之中，从刑法观中的罪刑法定主义到犯罪观中的犯罪成立理论再到刑罚观中的刑罚正当性理论，无不映射出民法理念的关怀人、关注权利的人性光辉。 源远流长的中国刑法以严峻冷酷留给国人太深的印象，也促使国人将其与血腥、暴力相联系。究其原由，中国刑法中过于庞大的国家刑罚权已将其自身权利保障的一面压制得残留不全。中国刑法需要重新认识、定位、建构，以一种现代化的面目去追随时代的发展，融入文明进步的世界潮流。以人为本、注重个人权利保障的民法理念正是解决中国刑法目前窘困的关键所在，以民法理念为导向来构建中国现代化刑法是中国刑法的基本路径和必然选择。树立刑法谦抑观、人道观以及进行民法理念指导下的现代化刑法立法和司法是以民法理念构建中国现代化刑法的模式。更多还原

【Abstract】 Criminal law is the public one , it is essential attribution to protect the whole social benefit ;civil law is the private one , it is basic aspect to guard the private interest .Criminal law means power ,civil law is on the behalf right .Apparently , it is different between criminal law and civil law .They can not lead to consolidation .However , in the Long process of history, we can find the aspect on which criminal law is relation to civil law .The individual is the most important and we should pay attention to its right , which relate criminal law to civil law .At the same time , the idea of civil law is the basic one of criminal law .The idea of civil law consists in criminal law completely and deeply . From the theory about crime and punishment being regulated in law ,to the theory on crime constructing , to the dependence of punishment , all is about to care for the private . Wherever there is the idea of civil law in criminallaw ,there is the light of affection.Criminal law of china has a long history and impress the Chinese due to severity and cruelty .Additional .Chinese usually consider criminal law as blood and violence .what is the cause ?The power of punishment is so huge that it conceals the right . criminal law of china is in need of recognizing and locating , and constructing as well .Pursuing the development of the times with modernizing behavior , criminal law of china will be involved in the world inclination . It is the key that the individual is the most important and we should pay attention to its right. To solute these difficulties , we should accept it . It is basic mean and necessary select to construct updating criminal law with the idea of civil law.
