【摘要】 公共政策违宪审查是现代宪法和宪政发展的最新趋势。它是为了切实保障宪法赋予公民的权利，与我们日常生活最为密切相关的一种审查。 本文首先对相关概念进行了分析，在明确公共政策、宪法、公共政策体系、公共政策违宪、公共政策违宪审查等词涵义的基础上，对公共政策违宪审查问题进行了重点地分析与论述：它以对公共政策违宪审查的价值分析为前提，从我国公共政策违宪审查的现状出发，对我国现存违宪审查模式中存在缺陷的危害以及造成审查难的原因进行分析，并在借鉴国外几种违宪审查模式优劣的基础上，最终提出了适合我国国情的违宪审查模式：建立以专门机构(宪法委员会以及条件成熟后建立的宪法法院)进行审查为主，以司法机关、行政机关、社会组织进行监督为辅；并通过相应的《程序法》与《监督法》来保障监督审查的违宪审查模式。这种模式既强调了以法律为主的审查模式，又体现了公共政策的灵活性、审查监督主体的多样性、监督的广泛与全面性，从而使公共政策的违宪问题在专门的审查和更多的监督中得以更好的解决，维护了宪法的权威，实现民主宪政!更多还原

【Abstract】 The unconstitutional review of public policy, which is for the sake of ensuring the citizen of their rights gifted by constitution, is the newest tendency of the development of modern constitution and constitutionalism.At first, this article analyzed some relative conceptions such as public policy, constitution, public policy system, contravening constitution in public policy system and unconstitutional review of public policy, then put the emphasis on analyzing the last problem: in term of the value of unconstitutional review of public policy, point out the harm of contravening constitution in public policy system and the reason for the difficulty of its review. Next, on the basis of drawing support from the models of foreign country’s unconstitutional review, this article put forward a model of unconstitutional review, which is suited for our state. This model is giving first place to establish special mechanisms including temporary committee and henceforth constitutional court to review, make using of another mechanism such as judicature body, administrative body and social body etc. to supervise, and according to the law of procedure and the law of supervision to assure constitutional effect. These models not only emphasize the law’s significance, but also stress the public policy system’s merit. It will make the question of unconstitutional review resolved more effective, stick up for the constitutional authority, realize democratic constitutionalism.更多还原
