【摘要】 从1979年我国第一部环境保护法(试行)颁布实施以来，我国的环境法制建设已走过了20多个春秋，取得了显著成果。我国的环境立法有一个特点，即普遍是针对某些环境要素的污染防治进行立法。而我国的地方性立法是对国家法律、行政法规的执行和补充，因而，地方性环境立法也具有这个特点。然而，作为一个区域的环境立法应当综合考虑区域各环境要素，制定出具有生态性、协调性、超前性和综合性的地方性环境立法，才能有效的保护区域整体环境。 本文主要针对昆明市环境立法的现状进行分析与完善，创新性的提出了一些完善昆明市现有环境立法的建议，使之成为一套具有生态性、协调性、超前性、综合性和可持续发展的昆明市环境法规和政府规章体系。主要研究内容有：论文的目的和意义，城市环境立法的概况，昆明市环境立法的现状及其分析，完善昆明市环境立法的目的、价值及其原则，完善昆明市环境立法的理论依据和宪法、法律、行政法规及其制度依据，完善昆明市环境立法的事实依据，外国环境立法的借鉴，昆明市水环境保护立法的完善，大气污染防治立法的完善、噪声污染防治立法的完善、固体废物污染防治立法的完善、旅游业环境保护立法的完善、野生动物保护立法的完善、循环经济立法的完善和其它环境方面立法的完善。希望本文能对昆明市的环境立法工作有一定的借鉴作用。更多还原

【Abstract】 Our country’s environmental legislation building has more than 20 years’ history, since the first environmental law brought into effect. And our country’s environmental legislation has a character that it mainly aims at the protection and control of some environmental factors’ pollution. Our country’s local legislation executes and reinforces the national laws and statutes. So, local environmental legislation in china has that character. But, as the district environmental legislation, it must pay attention to all of environmental factors. And then constitutes a system of local environmental legislation with the speciality of ecology, harmony, leading and integration. Thus, local environmental legislation can efficiently protect the whole distract environment.Based on the analysis of the present situation of environmental legislation in Kunming, the author brings forward some suggestion to perfect the environmental legislation in Kunming. So as to, constitute a system of Kunming environmental legislation with the speciality of ecology, harmony, leading and integration. This paper mainly studies the following : the purpose and meaning of this paper, city environmental legislation’s general situation, the present situation of kunming environmental legislation, the analysis of kunming present environmental legislation, the purpose, value and principle of perfecting kunming environmental legislation, the basis of perfecting kunming environmental legislation, the experience of four foreign country’s environmental legislation, water resources protection legislation’s perfection, water pollution prevention and control legislation’s perfection, air pollution prevention and control legislation’s perfection, yawp pollution treatment legislation’s perfection, solid discards pollution treatment legislation’s perfection, travel industry environmental protection legislation’s perfection , wildlife conservation legislation’s perfection , circulating economic legislation’s perfection and others.
