【摘要】 当前，我国经济迅猛发展而且加入了WTO，银行经营环境发生剧烈变化，金融自由化、国际化程度的提高，金融业竞争的加剧，使商业银行中间业务正在成为中国银行业在新的形势下发展的重要焦点和新的经济增长点。因此如何有效地把握中间业务的风险并使用法律手段对其监管规制是我国商业银行迎接挑战，求得生存发展而需亟待解决的问题。我们要在借鉴西方发达国家对商业银行中间业务风险管理、法律规制经验的基础上，建立符合我国经济发展要求的风险监控体系，用法律手段对中间业务风险进行防范，促进我国商业银行中间业务的健康发展。 目前，中间业务的开展虽然在表面上看未给商业银行带来明显的风险影响，但从长期看，大力开展中间业务，增加非利息收入将成为我国商业银行未来发展的趋势，而中间业务风险的潜在性亦不可忽视。加强中间业务的风险管理研究，对于促进我国商业银行中间业务快速增长、提高我国行业银行的竞争能力、保证我国金融体系的健康运行有着十分重要的现实意义。 本文中作者在对比中外商业银行中间业务的基础上，从分析中间业务的风险入手，进一步探讨如何用法律手段对中间业务规制。更多还原

【Abstract】 At present, with the Chinese economic developing fast, the environment of the commercial banks has changed a lot and "intermediate business" has become more and more important. For the further development of intermediate business, it is necessary to discuss how to control its risk efficiently and regulate it by law. Although intermediate business has no distinct risky influence on the commercial banks, still it will become a future developing trend in extending business and gaining non-interest incomes from long-term, so we can’t neglect the latent risks of intermediate business. Compared with the development of intermediate business of foreign commercial bank, now in China, during the course of the operation of the intermediate business, there are a lot of problems such as the imperfection of constitution and stipulation of risk management systems, the lag of legal supervising, etc. It is important and practically meaningful to commercial banks in promoting the rapid growth of intermediate business, enhancing its competence and ensuring the healthy operation of the financial system to strengthen researches of risk management of intermediary business.In the essay, based on the contrasting of the development of intermediate business between Chinese and foreign commercial bank, beginning from the analysis of various risk, the author will try to discuss how to regulate intermediate business by law.更多还原
