【摘要】 离岸金融是金融自由化、国际化的产物，虽然它仅有不到一百年的历史，但是发展迅猛，已经成为现代金融的重要组成部分，在国际金融市场上发挥着重要的作用，有学者认为它是真正意义上的国际金融。离岸金融市场的发展为国际资金的融通和国际债务的结算提供了便利，也为国际贸易、国际金融的发展起到了促进的作用。与此同时，离岸金融也存在消极作用，它加剧了金融风险，加大了金融控制的难度。二十世纪九十年代，国际离岸金融市场发生了新的变化，出现了相对衰落的趋势，各国对离岸金融的消极作用有了普遍的认识，加大了监管力度。 与传统的在岸金融相比，离岸金融的法律问题具有很大的特殊性。本文的研究主旨在于探究离岸金融法律问题的独特性并加以分析，进而对我国离岸金融市场的建立提出自己的意见和建议。文章首先介绍了离岸金融的一般问题，包括离岸金融及离岸金融市场的界定、组成等相关问题。其次，文章探究了离岸金融中的主要业务—借贷业务中特殊的法律问题，这部分也是本文的主体部分。尔后，文章对离岸金融的管理法律制度和监管问题做了论述，最后，作者讨论了我国离岸金融市场的存在的问题并提出建议。更多还原

【Abstract】 Off shore finance is the product of the financial liberalization and i nternalization. Though only has a history of less than one hundred year, it grows rapidly, and has become an important component of the modern finance, at the meanwhile, play an important role in the international financial market. Off shore offers facility for the international financing and the settlement of the international debts and facilitate the development of the world trade and finance. However, off shore finance also has negative factors. It raises the banking risk, makes it more difficult to control the finance risk. In the nineties of the twenty B.C, the off shore finance experienced great changes and has a declining trend. Every country has a comprehensive knowledge of the negative effects and strengthens the supervision over it.The off shore finance legal problems have their specialty compared with those of the on shore finance. The tenor of this thesis is to explore the special legal problem of the off shore finance and make an analysis, further more, to forward the views and suggestions of the author’ s own. The article, first of all, introduces the general problems of the off shore finance, including the definitions and the compositions of the off shore finance and the off shore finance market, etc. Secondly, the author deliberates on the legal problems of the essential operations of the off shore finance-debit and credit operation, which form the main body of the paper. Then, the article discusses the management and supervision on the off shore finance. At last, the author expounds the problems lie in the off shore finance market of our country and, at the same time, makes suggestions to it.更多还原
