【摘要】 动产抵押制度是工业化大生产的产物，它适应了工商企业寻求融资和不丧失对抵押物使用收益的双重需求，为促进社会经济的发展起到了积极的作用。但由于动产抵押是设定在动产上的不转移占有的担保物权，动产的易于移动性，使动产抵押存在严重的公示缺陷，而动产抵押登记制度正是解决这一问题的关键所在。我国建立动产抵押制度的历史很短，对动产抵押登记制度的规定尚不完善。本文在介绍了动产抵押登记制度的缘起之后，从法理学和经济学的角度对动产抵押登记制度的效力以及其责任保障机制进行了分析，并针对我国动产抵押登记制度立法存在的问题和不足提出完善建议。全文分为四个部分： 第一部分阐述了动产抵押登记制度的缘起。该部分首先解释了动产抵押的概念，然后阐明动产抵押制度的价值以及在其运用中陷入的困境，在对其陷入困境的原因进行剖析基础上指出登记制度是解决动产抵押适用困境的最佳办法，并对引入动产抵押登记制度的现实意义进行了探讨。 第二部分从法理学和经济学的角度对动产抵押登记制度的效力进行了详尽的分析。在对动产抵押登记效力的概念、立法模式等进行介绍之后，具体分析了其内容、作用对象以及时空范围。 第三部分分析了动产抵押登记制度的责任保障机制。指出动产抵押登记制度涉及到的各种法律责任，包括民事责任、行政责任和刑事责任。对如何惩戒违法者，保障动产抵押登记制度的贯彻实施进行了探讨。 第四部分剖析了我国动产抵押登记制度立法中存在的缺陷与不足，并提出相应的改进措施。更多还原

【Abstract】 Chattel Mortgage is the product of industrialization. It meets the industrial and commercial enterprise’ s requirements including financing and usufruct, and plays a positive role in the development of social economy. However, as for the public summons, chattel Mortgage has serious defects for the non-transferring possession of objects and the mobility of chattels. The registration system of chattel mortgage is just the key to this problem. In our country, the history of chattel mortgage is very short and its pertinent provisions are not perfect yet. After introducing the rising reasons of chattel mortgage, this thesis analyzes the validity and ensuring mechanism of liability of the registration system of chattel mortgage from the kens of jurisprudence and economics, and puts forward some promoting suggestions to this system of our country. This thesis consists of four sections:The first section demonstrates the rising cause of the registration system of chattel mortgage. This section expounds the concept, value and the predicament in application of the registration system of chattel mortgage. On the basis of analyzing the cause of its predicament, this section points out that the registration system is the best way to resolve this problem.The second section explores the validity of registration system of chattel mortgage in detail from the kens of jurisprudence and economics. On the basis of introducing the concept and legislative model of the registration system of chattel mortgage, this section analyzes its contentthe object and the scope in detail.The third section analyzes the ensuring mechanism of liability of the registration system of chattel mortgage. This section points out that this system involves several kinds of liabilities, including the civil liability, the administrative liability and the criminal liability. In order to find a way to punish the lawbreakers, this section explores how to ensure the execution of the registration system of chattel mortgage.The fourth section points out the legislative flaws of the registration system of chattel mortgage in our country and puts forward some corresponding promoting suggestions.更多还原
