合议制研究

【摘要】 文章结合我国司法实践，对诉讼合议制度的共性与我国合议制的现状、特点、问题、改革等进行了比较深入的研究。文章共分三部分。首先，简述合议制概念、类型、特征、意义、缺陷和沿革。其次，阐述我国合议制立法和运作情况，包括其方式、适用范围、组成；认为我国合议组织包括合议庭和审判委员会；指出合议庭判决书部分由庭长院长签发是不理想的审判分工。最后，提出改革合议制的若干建议，指出确保合议庭成员平等参与、共同裁判，合议庭统一和完整行使审理权与裁判权，实现独立、公正、高效的审判机制，是合议制改革的目标，论述合议制改革应与整体司法改革、法律改革等配套进行，从国情出发，循序渐进。更多还原

【Abstract】 The article combines the administration of justice of our country to practise, discuss jointly lawsuit generality and of our country current situation , characteristic , issue , reform of collegiate system of system ,etc. carry on deeper studying. The article divides into three parts altogether First of all , sketch collegiate system concept , type , characteristic , meaning , defect and evolution. Secondly , explain legislating and operation situation of collegiate system of our country , including its way , scope of application , making up; Think that our country discusses the organization including collegiate bench and tries the committee jointly; Point out that it is the unsatisfactory trial that the part of the court verdict of collegiate bench is signed and issued by presiding judge’s president to divide the work. Finally , propose reforming several suggestions of the collegiate system , point out that guarantees that collegiate bench members participate in equally , act as referee together, the collegiate bench unifies and exercises and tries right and jury diction intactly, realize independence , just , high-efficient trial mechanism, collegiate system goal of reform, expound the fact collegiate system reform should go on with whole administration of justice reform , legal reform ,etc. together, proceed from national conditions, follow in order and advance step by step.更多还原
