金融机构市场退出机制的法律问题研究

【摘要】 金融机构有市场准入就必须遇到市场退出问题，这是市场经济的客观规律，也是金融法学研究的重要课题。本文在阐述金融机构市场退出几个基本问题的基础上，把金融机构市场退出作为一个机制、一个系统化的工程，从金融机构市场退出的预防性机制、市场退出方式、保障支持机制和内部协调机制等方面对国外相关的法律制度设计及其运行情况和借鉴意义进行了深入研究和论述。通过对国外先进经验的借鉴，进而针对我国目前金融机构市场退出中存在的宏观的和微观的问题，提出个人完善我国金融机构市场退出机制的粗浅看法和立法建议。除前言外，本文主体部分共分为四章，包括金融机构市场退出机制概说、国外金融机构市场退出机制的实践和相关立法、我国金融机构市场退出的现状及存在的问题、构建我国金融机构市场退出机制的立法建议，共3.2万字。研究表明，在我国金融机构市场退出实践日益丰富的今天，开展对金融机构市场退出机制的深入研究，借鉴国外成熟的经验，吸取国外失败的教训，对我国金融业的健康发展有着重要的现实意义。更多还原

【Abstract】 Financial institution has the problem of withdrawing from the market，this is a impersonal rule of market economy and an important problem of financial law. The article regards financial institutions market withdrawal as a mechanism, a systemic project on the base of expatiating several essential issues. The article made a comparative research to constitution and effect of foreign financial institutions market withdrawal mechanism and discussed many experiences that can use for reference to us. Learning from experience, the article put forward my superficial point and suggestions for legislation to the question of microscopically and microcosmic problems in the course of financial institutions market withdrawal of China.Besides the preface, this article is divided into four chapters, including generality of financial institutions market withdrawal mechanism, the mechanism’s practices of foreign country and related legislation, the actuality of Chinese financial institutions market withdrawal mechanism and the existing problems, the legislation advices for the construction of Chinese financial institutions market withdrawal mechanism.Researching indicates that with the development of Chinese financial institutions market withdrawal practices, analyzing the financial institutions market withdrawal mechanism, using foreign mature experiences for reference is of important significance for the development of Chinese financial industry.更多还原
