【摘要】 在建设工程实施过程中，由于合同所引起的纠纷、索赔等问题屡屡发生，成为工程索赔的首要原因。研究发现，主要原因在于：把目光放在工程实施过程中的合同管理及合同索赔上，对于前期的合同策划关注不够，致使合同在签定之初就留下了缺陷。本文以此为出发点，对建设工程合同策划的相关问题进行了研究。 本文主要对业主方合同策划的问题：项目承发包模式的选择、项目采购方式选择及合同类型的选择进行了研究。提出了承发包模式选择依据，即符合建筑业的发展趋势、充分考虑工程的性质、体现项目双方的情况；以及采购方式选择考虑因素，即采购时间、采购费用、采购方式所能达到的效果、伙伴关系。并分析了固定工程量总价合同作为总价合同与单价合同的中间形式，自身所具备的优势以及适用范围等情况。承包商的合同策划主要研究了承包商面临的风险分析及合作方式的选择两方面。 最后，本文针对《建设工程施工合同》在应用中值得商榷的条款，对比FIDIC新红皮书相应的条款进行分析。并提出了《建设工程施工合同》的改进建议更多还原

【Abstract】 Many disputes and claims caused by engineering contract occurrence frequently, during the project performance, which has become the first factor of engineering claims. Analysising the problem we can find what reduces the situations is that less concern to engineering contract makes the contract including some blemishes signed. So the project is doomed to fail at first. Concerning this point, this paper has researched the related questions about the engineering contract programming.This thesis puts efforts on the questions of owner’s engineering contract programming. In this part, the following is researched: the choice of project contracting mode, the choice of purchasing mode and the choice of contract types. Then the thesis studys the contractor’s engineering contract programming which includes the contractor’s risks analysis and the choice research about their cooperation mode. At last, this paper puts our construction contract compared with conditions of contract for construction of FIDIC and through the comparison between two conditions of contract, brings up suggestions for our construction contract.更多还原
