失业保险法律制度研究

【摘要】 失业保险是现代文明的一项重要制度，它是指劳动者在由于非本人的原因，暂时失去工作，中断收入，失去生计来源时，从社会获得物质帮助的一种社会保障制度。1911年，英国颁布的国民保险法，对该国失业保险作出规定，开创了强制失业保险的先河。 失业保险作为社会保险的一部分，与工伤、养老、生育、疾病保险等项目并列。微观上，失业保险维持了失业者的基本生活；宏观上，它承担了防预风险的职能，在一定程度上调节供给和需求，保障社会稳定，保持社会公平。纵观历史，失业保险制度是经济发展到一定阶段的产物，是国家解决经济社会问题不得不采取的手段；横向而看，多数国家的失业保险基本结构大体相同，但由于受政治、经济、历史文化传统的影响，又在具体制度和实施上呈现出各自特色。 把我国的失业保险与西方发达国家的相比，更是存在很多不同，最突出地体现在西方发达国家的失业保险制度，是建立在私有制为主体、市场经济充分发展，生产力水平很高的基础之上，而我国的失业保险则是在以公有制为主体，正在由计划经济向社会主义市场经济过渡，生产力水平较低的条件之下建立与发展的。失业保险在西方国家已具有一个世纪的历史，在此期间，西方国家积累了许多有益经验。完善我国的失业保险制度就要从我国国情出发，取百家之长，补己之短。总结以上，文章脉络为：以失业保险制度的萌芽和形成过程为背景，叙述失业保险法律制度的内容；通过简介美国、英国、德国、瑞典等国的失业保险制度，呈现失业保险的灵活性与多样性；分析我国失业保险的产生、发展与现状，初步构想它的未来。更多还原

【Abstract】 Unemployment insurance is one important system of modern civilization, that mean labourer because out reason of themselves, Lose the job temporarily , cut off income , lose livelihood on the source, get a kind of social security system that the material helps from the society. In 1911 , national law of insurance that Britain issue, make stipulations to insurance, unemployment of country, this, Start the beginning of forcing the unemployment insurance.Unemployment insurance as a part of social insurance, is project tie for with industrial injury, living out one’s life in retirement, parenting, sickness insurance,etc. Microcosmic , unemployment insurance maintained the jobless’ basic life; Macroscopic , it undertake defend function of the risk in advance, regulate supply and demand to a certain extent and ensure the social stability, keep the society fair .Make a general survey of history, unemployment insurance system raise with economy developing into certain result of stage. It is the means that country take to solve economic social problems. Horizontal looking, most country unemployment include the same on the whole. Affected by politics, economic, historical cultural tradition , implement have appear to each characteristic in concrete system.Compared with western developed country, unemployment insurance of our country exist a lot differences especially.In western developed country unemployment insurance system set up in private ownership , market economy developed fully, on the high foundation productivity level; the unemployment insurance of our country is relying mainly on public ownership , is being carried out the transition from planned economy to socialist market economy .productivity level in low terms seting up development. Unemployment insurance have one history of century already in western countries, during this period, the western countries have accumulated a lot of experience of benefitting.
