社会转型期我国行业管理的有关法律问题研究

【摘要】 我国目前正处在社会转型期之中。社会转型对我国行业管理的发展产生了重大影响。它促使了政府——行业协会——协会成员间新型关系的形成，并由此引发了调整政府与行业协会间关系、行业协会与其成员间关系以及政府与行业协会成员间关系的法律问题。本文以我国当前处于社会转型期为基点，结合行业管理的基本理论，考察分析我国现行相关法律制度，参照国内外已有的先进经验，对上述行业管理有关法律问题进行了研究，提出了尽快制定《行业协会法》、《反垄断法》、《计划法》和修改《行政诉讼法》、《反不正当竞争法》的具体建议，及以此构建我国行业管理法律制度的初步设想。更多还原

【Abstract】 China now is in a period of transition. The transition has exerted a great impact on the development of industrial management in China. It has promoted the formation of new relation among the administration, the associate and members of the associate and also resulted in some legal issues on adjusting the new relation. In this essay, under the background of transition period, on the basis of utilizing some theories about industrial management and analyzing domestic and foreign law and judicial practice, I will do a research on the legal issues mentioned above and put forward advice to legislate and perfect relevant law.更多还原
