城市土地收购储备的理论基础与现行模式的比较研究

【摘要】 起源于上个世纪90年代后期的我国土地储备制度是我国经济体制改革大背景下城市土地管理领域开创的一项制度创新,它是在我国土地使用制度改革、土地市场的发展及国有企业改革过程中应运而生的一种土地管理制度。在中央政府的大力推动和地方政府增加地方财政收入双重驱动下,城市土地收购储备制度发展迅速,到目前为止,全国已有近1300个城市相继建立了城市收购储备制度。城市土地储备制度的建立,产生了良好的社会效益和经济效益,对于规范和培育土地市场、增加政府的财政收入、促进城市规划的合理实施等都具有十分重要的意义。 同时,作为一项新生制度,当前城市土地收购储备制度的理论研究和实践尚处于起步阶段,缺乏深入系统的研究,导致各地城市土地储备制度的运作模式、运作效果不一,实施过程中存在着法规不配套、机制不健全等问题,从而影响了城市土地储备制度的运作、发展和规范。为此,有必要在客观上深入的探讨和研究这些问题,分析产生的深层次原因,研究在现行条件下可行的解决途径及进一步规范和发展的方向,通过理论指导和实践探索相结合来完善城市土地收购储备制度。 本文首先在综合分析国内外土地收购储备制度研究进展基础上,综合运用土地市场理论、市场失灵理论、政府失灵理论、政府经济学理论、产权理论和制度变迁理论等经济理论,提出了土地收购储备制度的理论依据;其次,分析海外土地收购储备制度实施的背景、运作模式和实施效果,得出了海外土地收购储备制度实践对我们的启示;然后,对我国现有的三种土地收购储备典型模式进行多方面的比较和分析。最后,以杭州市为典型案例,从理论和实践两个角度分析了政府主导型土地收购储备模式的必要性,然后从机构、运作程序、配套政策等方面提出如何构建政府主导型土地收购储备制度,在对土地收购储备制度进行了绩效分析后,针对杭州市土地收购储备制度实践中暴露出来的问题和情况,从发展和完善本制度的角度出发提出了一系列可行的政策建议。

【Abstract】 As an innovation of Chinese urban land institution under our country economic restructuring background, the urban land reserve institution started from 1990 later periods. As a kind of land management system, the land reserve institution arise from the reformation of land use the development of land market and the reformation of State-owned enterprise. Drove both by central authorities’ vigorously impetus and by the local authoritys’ motivation of increasing local finance income, the urban land reserve institution has progressed rapidly recentlly. Nearly 1,300 cities has established the urban reserve institution up to now.The establishment and implementation of the institution has bringed much social benefits and economic benefits. It is vital for for standardizing and cultivating land market , increasing finance of government promoting rational implementation of urban planning and so on.Meanwhile, as a new born institution, the present theoretical research and practice of urban land reserve institution are still at the starting stage, lacking further systematic research The extant problems of the institution such as different modes and effect in different city uncoordinated regulation and imperfect mechanism,have become an obstacle of the perfection of the institution. Therefore, it is necessary to study these problems objectively analyze the profound reasons study the feasible settlement and direction of standardizing and development under current condition , resolved these problems through theory and practice in order to perfect the urban land reserve institution.On the basis of synthetical analyzing the studying progress of the land reserve institution ,the paper uses several economic theories ,such as the theory of land market the theory of market failure the theory of government failure the theory of government economics the theory of property right and the theory of institutional change , to of put forward the theoretical foundation of land and reserve institution. Secondly, on the basis of analyzing the background . operation modes and implementing effect of the overseas land reserve institution, this paper draws the enlightenment for us of overseas 1 practice. Thirdly, Third, the paper carries on the various comparison and the analysis to the existing three kind of lands reserve typical modes. Takinig regarded the mode of Hangzhou as the typical case ,the paper analyzes the necessity of the mode of leading by the government Finally ,discussed the achievements brout by the institution and the current Problems of mechanism of Hangzhou urban land reserve institution, the paper put forward a series of feasible tactics and suggestion TO develop and perfect this institution.
