【摘要】 “文化认同”是文化学领域一个重要而被广泛运用的概念。“法律文化”则是我国20世纪80年代兴起的一门新兴学科。作为一门新的学科，法律文化有待各门具体研究方法和视角的充实和完善。所以，把“文化认同”作为一种具体研究方法或视角，引入对法律文化的研究具有其独立的理论意义。关于“法律文化认同”的现实意义，笔者认为：1、法律文化认同能促进人们对社会经济基础的法律要求的认知和共识，为法律制度的评价提供了客观的标准。2、法律文化认同能使人们不断自觉调整自身行为以增强对新生法律制度的适应性，也能使立法者根据法律效能状况不断修改完善法律制度，使执法者正确适用法律和正确使用自由裁量权，它是法律利益冲突的有效缓冲器。3、法律文化在精神文化领域能逐步改良人们的法律心理，更新人们的法律观念，并促成有民族特色的法律思想体系的形成。4、法律文化认同既是大众文化与精英文化冲撞和交融的结果，也是两种文化潮流联系互信的纽带，它的存在增加了民族的文化凝聚力。5、开放型法律文化认同是中国古老文明与现代文明的一种有效对话工具，它有力地推动着整个社会的转型和文化的转型。由于目前国内法学理论界对法律文化认同问题尚缺乏研究，所以，此文是对该课题一种开拓性、尝试性的探索。笔者从概念、结构层次、现实社会意义、社会影响因素、实现途径等方面对法律文化认同进行了系统分析和论证，并借助“法律文化认同”的认识工具对当代中国法律文化的发展进行了重新的分析和梳理。更多还原

【Abstract】 "Culture-identity" is an important concept widely used in the field of culturology. "Legal culture" is a new branch emerging in China during 1980s. As a new branch, Legal culture has much room for improvement and enrichment in the aspect of various specific research methods and angles of view. The introduction of "culture- identity" which is a specific research emthod or an angle of view is of independent theoretical significance. Concerning the current significance of "legal culture-identity", the author holds:1、Legal culture-identity can help people form identical knowledge of the legal requirement about people with an objective standard about the evaluation of legal system.2、Legal culture-identity can help people continually conscientiously regulate the behavior of the self so as to develop the adaptability to the new legal system. It also can help legislators continually revise and improve the legal system in line with the situation of legal effectiveness and it can help law executors correctly apply the law and the right of discretion. It is an effective buffer of the conflict of legal interest.3、Legal culture can continually improve people’s legal psychology in the field of culture and ideology. It can renew people’s legal views and form the legal ideological system of the national characteristics.4、Legal culture-identity is not only the outcome of collision and mingling between mass culture and elite culture but also the tie of connection and mutual trust of two kinds of culture tides.5、The open legal culture-identity is an effective means of talk between traditional Chinese civilization and modern civilization. It forcefully promotes the whole social and cultural transition. Owing to the fact that there is little research about the legal culture-identity in the field of juristic theory in the Chinese mainland. This thesis is a<WP=17>pioneering and trial exploration of the said problem. The author systematically analyses and proves the legal culture-identity from such aspects as concept, structural arrangement, social practical signficance, social influence factor and the way of realization.
