【摘要】 近年来互联网络的迅猛发展已经使之成为广受关注的对象。网络是否需要管制，如果需要管制又如何管制是我们当前所面对的一大难题。本文认为网络应该管制，而管制主要以立法的途径进行。论文从行政法的角度对网络管制立法的特点、原则、模式及其发展趋势进行分析，并对我国当前网络管制立法的缺陷及其成因进行探讨，指出要完善我国网络管制立法，必须考虑到立法模式的选择和相关原则的修正，同时还必须注意机构的设置、管制对象的选择、市场作用和技术因素的发挥、责任和救济体系的完善和国际网络管制发展趋势的重视等几个需要关注的问题。本文最后试拟了一份《互联网信息服务管理法》作为全文的总结。更多还原

【Abstract】 The rapid development of Internet had made it been averted by many people. We have met the question that whether the Internet need to be regulated, if it need to and what to do?We believed that the Internet should be regulated and analysis the character, principle, mode and trend of Internet regulation legislation in a administrative view. Then I analysis the limitation and reason of the current internet regulation legislation and realized that our internet regulation legislation must pay attention to the choosing of the legislative mode and revising the legislation .In the same time some important questions such as institution’s setup, regulated object’s choosing, the effect of market and technique’s exertion and relief system’s perfect must to be taken into account of our internet regulation legislation. As a sum-up of the article, I drafted a legislation draft of the law of Internet information service regulation.更多还原
