【摘要】 电子文件证据问题是当前档案界、法律界和计算机技术界研究的热点，本文就电子文件证据的相关问题，作了较为系统和全面的研究，全文共分五部分： 第一部分：电子文件证据的概念及其特点 第二部分：电子文件证据的可采性及证据力分析。并且分析了中外有关这方面的法律法规。 第三部分：电子文件证据的法律定位。通过不同观点的分析比较，揭示电子文件证据应该成为独立的证据。 第四部分：电子文件证据价值的确认。从法律制度、组织机构、管理措施、技术措施四个方面来确保电子文件证据得以实现。 第五部分：电子文件证据取证及其审查判断。更多还原

【Abstract】 Now days, the studying on legal issues of electronic documents evidence is one of the most hottest spots in archival science, law science and computer science. The thesis discusses the issue that whether electronic documents evidence can be used or not and how it be used for evidentiary purposes, the thesis consists of five parts, about 34000 Chinese characters, First of all, a definition and feature on the electronic documents evidence is given by the thesis. Secondly, the admissibility of the electronic documents evidence and the analysis about its ability of evidence, moreover some analysis about home and abroad laws provided, Third, the status in law. By comparing the different views a conclusion can be drown that electronic documents evidence should have its independent status, Forth, the affirmation of its value.
