论东盟自由贸易区框架协议的实施及其进展

【摘要】 东盟经济合作的突破性进展始于90年代初。90年代以前，《特惠贸易安排协定》(简称PTA)作为东盟经济合作的主要机制，对东盟经济合作曾起到一定的推动作用。93年以来，《共同有效优惠关税基本协定》(简称CEPT)取代了PTA而成为东盟经济合作及实现东盟自由贸易区的主要机制，在朝着经济一体化方向发展的前提下，为建立自由贸易区而形成了以CEPT为主的一系列协议、协定、计划、声明、宣言所构成的法律体系，构成了东盟自由贸易区框架协议的主要内容，它是东盟建立自由贸易区计划的纲领性文件。框架协议规定了东盟国家经济发展的基本方向——建立东盟自由贸易区。本文讨论的重点是东盟自由贸易区框架协议实施进展中的一些主要问题，比如说，关税减让问题，框架协议对东盟经济发展的影响等。为方便起见，本文提到的框架协议均指自由贸易区框架协议(特别说明的除外)。 自93年以来，在东盟自由贸易区框架协议的实施进展中，框架协议显示了其巨大的“凝聚力”，对东盟经济发展产生了深远的影响，关税的大幅度削减以及自由贸易区的建立，使东盟在经济一体化的进程中迈上了新的台阶。本文第一部分写了东盟自由贸易区框架协议的来源，以及框架协议的主要内容。第二部分重点讨论了框架协议实施进展中的关税削减情况及目标时间的调整情况；第三部分讨论了框架协议对经济发展及东盟经济一体化进程所起的作用。 通过本文的讨论可以使我们对东盟自由贸易区的进展情况有所了解，也可以看出框架协议作为一种纲领性的法律文件，对区域经济发展所产生的重要作用。更多还原

【Abstract】 The breakthrough development of economic cooperation of ASEAN began with the beginning of 1990s. Before 1990s, Special preferential trade arrangement pact (shortened form PTA) as the main mechanism of economic cooperation of ASEAN exerted some driving forces to the economic cooperation of ASEAN. Since 1990s, Cooperation Effective Preferential Treatment (shortened form CEPT) has replaced PTA and become the main mechanism of economic cooperation and realization of free trade area of ASEAN. Presupposing develop along economic integration, in order to free trade area, the legal system that consists of a series of agreements, pacts, plans, statements and declarations has shaped. Its main content is CEPT. It made up of the main content of free trade framework agreements and was the programmatic document of establishing free trade area of ASEAN. Framework agreements prescribe the basicdirection of economic development of ASEAN countries------to establish free trade area of ASEAN. Thethesis focuses our discussion on some principal problems, for example, the problem of custom decreasing. influence of framework agreements on economic development of ASEAN etc, in the implementation process of free trade framework agreements of ASEAN. In order for convenience, framework agreements spoke of in this thesis all refer to free trade agreements ( except those need special explains).Since 1993, in the implementation process of framework agreements of ASEAN, framework agreements has displayed great "cohesion’ and exerted profound influence. Framework agreements discussed in the thesis mostly point to mechanism of custom decreasing that gives priority to CEPT. At the same time, the contents also consist of some relevant contents to establish free trade area and to decrease custom. The latter is the complement , revise and consummate to the former. The first part of the thesis expounds the sources of free trade framework agreements of ASEAN and component parts, a series of agreements pacts plans declarations etc, of framework agreements. The second part focuses our discussion on the situations of custom decreasing and aim’s time- adjusting in the implementation process of framework agreements. The third part discusses the influences of framework agreements on economic development. The final majority aim is to discuss and analysis the situations of implementation and progression of free trade framework agreements of ASEAN. Because of seeking particularity, the custom decreasing of discussion in the second chapter, lists importing custom decreasing of 21 major kinds of goods. In view of structure, I don’t do much analysis of charts. On the one side, 1 think charts can explain problems by themselves; in addition, some analysis is listed in the contents of third chapter to explain the influence of framework agreements on economic development.Through the discussion of the thesis, we can get some knowledge about progressing situations of free trade area of ASEAN. Meanwhile we can make out framework agreements as a kind of programmatic legal document exert important effectiveness on area economic development.更多还原
