BOT合同的法律问题研究

【摘要】 目前，BOT合同的许多法律问题都是理论界探讨的热点。然而对在BOT合同的履行过程中扮有重要角色的BOT合同法律适用问题却少有系统论述。一是由于BOT合同的庞杂性，且BOT基础合同的法律性质至今尚无定论；二是我国没有一部专门针对BOT投资方式的法律规范，目前现有的法规不能满足调整BOT投资方式的要求。因此本文在探讨BOT合同法律性质的基础上对BOT合同的法律适用问题做以探究，并由此构建我国BOT合同的法律适用规则体系，从而建立起完善的BOT投资方式法律制度，推动BOT方式在司法实践中的发展。更多还原

【Abstract】 Nowadays a lot of legal questions of BOT contracts are the hot topics discussed in the academic circles. However the legal application of BOT contracts, which is very important in the performance of BOT contracts, is lack of systematic exposition. One reason is that BOT contracts are very complicate. The other one is that there is no final conclusion about the nature of BOT basic contracts till now and there are no special laws and regulations about the BOT project. The present laws can’t meet the demands in the legal adjustment of BOT project. Therefore, on the basis of the analysis of the legal nature of BOT contracts, this paper studies the legal application of BOT contracts and composes the system of rules on it, thus to establish and improve the legal system of BOT project and promote the its development in the judicial practice.更多还原
