受贿罪共同犯罪问题研究

【摘要】 第一部分 受贿罪共同犯罪的基本构成 从受贿罪共同犯罪的基本构成上，论述了在受贿罪共同犯罪中非国家工作人员可以构成受贿罪的共犯；非国家工作人员可以构成受贿罪的共同实行犯、教唆犯、帮助犯等共犯形态。 第二部分 关于单位共同犯罪问题 论述了单位可以作为受贿罪共同犯罪主体，单位受贿共同犯罪表现形式及特征。 第三部分 国家工作人员与非国家工作人员共同实施受贿犯罪的定性与处理 这部分主要是解决司法实践中存在的一些疑难问题，列举分析了国家工作人员与公司企业人员共同受贿的定性与处理；单位与自然人共同实施受贿行为的定性与处理等问题 第四部分 关于“家庭型”共同受贿犯罪的定性与处理 这部分详述了家庭型共同受贿犯罪的特点，具体分析了共同受贿故意的类型。分述了家属参与受贿犯罪行为性质和处理。 第五部分 受贿罪共同犯罪人的犯罪数额及其刑事责任 犯罪数额在受贿罪中是最重要的定罪量刑情节。在共同受贿案件中，受贿罪的犯罪数额存在分配问题。通过对几种观点进行辨析，得出结论，对于共同受贿案件中各共犯，首先应当按照犯罪总额说的标准确定量刑的法律条款依据，在此基础上将个人分赃数额作为情节予以考虑。更多还原

【Abstract】 This paper takes up the following 5 parts.1. The basic constitution of joint bribery crime.From the basic constitution of joint bribery crime, it discussed that non-statpersonnel can constitute the accomplice of bribery crime; non-state workingpersonnel can constitute the joint crime practitioner, the instigator and the helper ofbribery crime.2.Regarding the questions of unit joint crimeIt’s discussed that a unit can be taken as a joint crime subject, the manifestation andcharacteristic of which are also exploited in this part.3. The determination and disposition of joint bribery crime for the state andnon-state working personnel.This part aims at solving some difficult questions in legislative practice, such as the determination and disposition of joint bribery crime for the state working personnel and the cooperation businessmen, the unit and the natural person, etc. 4.The determination and disposition of family joint bribery crime. The nature and disposition of family joint bribery crime are analyzed and discussed. 5.The criminal quantity and the criminal responsibility for the joint criminals. The criminal quantity is the most important element of criminal determination and penalty measurement. By analyzing some viewpoints, it is concluded that for every joint bribery criminal, the criterion of criminal quantity should be taken as the foundation of penalty measurement, on the basi? of which, the shares of personal spoils should be considered as a special criminal plot when measurement of penalty is made.更多还原
