论交通肇事罪

【摘要】 本文对交通肇事罪作了系统论述。文章共分四大部分： 第一部分：交通肇事罪的理论发展与立法演变。本部分从纵向阐述了新中国成立后关于交通肇事罪的理论发展与立法演变过程，针对我国现行刑法规定的内容及相关的司法解释，提出了进一步研究的必要性。 第二部分：交通肇事罪的概念及特征。本部分从主体方面、主观方面、客观方面、客体方面对交通肇事罪的特征进行了论述。在主体方面，主要论证了驾驶非机动车辆、人力船舶的行为人和车辆主管人员(所有人、承包人)、行人、乘车人能够成为交通肇事罪主体的理由。主观方面，论证了交通肇事行为人主观上的两种过失情形即疏忽大意的过失和过于自信的过失，对怎样判断行为人的预见能力、过失犯罪中行为人的注意义务问题进行了探讨，并对国外的“相互信赖”原则进行了评价。客观方面，论述了交通肇事罪客观上的四个构成要件和交通事故发生的范围问题。在客体方面，指出了交通肇事罪侵犯的客体是交通运输安全。 第三部分：交通肇事罪的司法认定。本部分从交通肇事罪罪与非罪的区分、交通肇事罪与其他近似罪的区分、交通肇事罪共犯的认定、交通事故责任的认定、交通肇事罪的责任分担等方面进行了探讨，指出了在司法实践中存在的问题，并提出了自己的看法。 第四部分：交通肇事罪的刑罚适用。对交通肇事罪的三个量刑单位进行了论述，主要对怎样认定“交通肇事后逃逸”和“因逃逸致人死亡”两个问题进行了探讨。最后，提出了交通肇事罪在刑罚规定方面存在的立法缺陷。更多还原
