【摘要】 思想政治教育法治化是指在宪法和法律的范围内，建立和完善思想政治教育的法律、法规和制度体系，依法进行思想政治教育活动，使思想政治教育处于依法治理的状态之中。思想政治教育法治化就是要使我国的思想政治教育制度化、规范化，具有可操作性和说服力，增强思想政治教育的有效性，克服思想政治教育中的人治倾向和随意化倾向，保护合法的思想道德自由。它是提高思想政治教育的有效性，充分发挥其“生命线”作用的保证，也是依法治国的客观要求。思想政治教育法治化的研究在理论和实践上对思想政治教育都是意义极其重大的。 本文从理论和实施两个方面对思想政治教育法治化进行了探讨。首先从我国依法治国的基本国策、思想政治教育自身的可调控性和它的宪法法律基础等方面论述了思想政治教育法治化的前提条件；接下来分别对思想政治教育法治化的必然性和可行性进行了论证。思想政治教育法治化的必然性表现在它是社会主义市场经济的必然要求、社会主义主导意识的必然趋势、社会主义政治文明的必然结果及其自身创新的必然结论等四个方面。思想政治教育法治化的可行性表现是在哲学、政治学、法律等各个领域都有它存在的可行性理论基础。 本文把思想政治教育法治化的具体实施分为三个方面进行研究，即思想政治教育内容的法治化、实施手段的法治化和管理的法治化。在思想政治教育法治化的实施过程中，前提是要建立和完善思想政治教育内容、实施手段和管理等各个方面的法律法规制度，使其有法可依，但关键是要严格依法进行，在进行思想政治教育中以法律为准、为上。思想政治教育法治化不是限制思想自由的枷锁，而是限制人治、限制随意、保护思想自由 西南交通大学硕士研究生学位论文 第OI 页的武器。对思想政治教育法治化具体实施的成败评判，我们必须坚持以“三个代表”和人的全面发展这两个标准。更多还原

【Abstract】 The rule-by-law of the ideological and political education is in the constitution and law to found and perfect system of the laws and regulations, and to be in progress the ideological and political education by the law and to make it be in the government by law. The rule-by-law of the ideological and political education is just to make it have stability and be manipulated and authority, and to overcome its inclination of the rule by man and free rein, in order to guard the freedom of the legal ideology and ethics. It is a guarantee that improving effectivity of the ideological and political education and brings into play fully its affect of "lifeline" . It is also the objective requirement of the ruling country by operation of law. Besides, It has a great important meaning in the theory and the practice.This dissertation study the rule-by-law of the ideological and political education on two aspects of the theory and the implement. Firstly, it discusses premise of the rule-by-law of the ideological and political education by the basic state’ s policy of the governed state by law, and the rule-by-law of the ideological and political education can be regulated itself and the base of the constitution and law. The inevitability of the rule-by-law of the ideological and political education display that it is the necessity requirement of the market economy and the necessity tendency of the socialism’ s leading consciousness and the result inevitable of the socialism’ s political civilization and the conclusioninevitable of the innovation itself. Its feasibility is base on the each territory of the philosophy, politics and laws and so on.This dissertation study to concrete effect the rule-by-law of the ideological and political education by three aspects. This is the content and the means and the administration of the rule-by-law of the ideological and political education. In this course, its premise is to found and perfect there laws and regulations and to make it that there are laws to adide . And its key is to implement strictly by the law and it is not exceed. The rule-by-law of the ideological and political education is not a chain to confine the freedom. But it is a weapon that it restricts the rule by man and adlib, in order to protect ideological freedom.
