【摘要】 行政处罚是一种具体的行政行为，但它实施时受行政处罚制度的制约。海事行政处罚作为行政处罚的一个分支，由于其具有涉外性，它有其自身的特点，但是由于习惯做法和习惯思维方面的原因，以及法治发展程度方面的原因，在海事行政处罚规范及这些规范的具体实施方面，都还存在着诸多有待于进一步研究和探讨的问题，尤其是目前我国已加入WTO，海事行政处罚面临着新的形势和考验，急需在理论研究的基础上进一步健全和完善海事行政处罚制度，这是本文写作的基本出发点。本文对海事行政处罚制度的基本问题进行了研究和探讨，其主要立足点是我国的现行海事行政处罚制度。在本文中，首先介绍了海事行政处罚所涉及的当事人——海事行政主体、海事行政相对人即海事行政法律关系主体和海事行政管理的基本问题；其次对我国现行海事行政处罚制度进行了概括和归纳；然后对目前海事行政处罚存在的问题进行了讨论和评析；接着列举了三个典型的海事行政处罚案例，并对其进行了点评，在本文的最后，对现行海事行政处罚的法规存在的问题进行了剖析，并在此基础上提出了完善海事行政处罚现行法规的修改建议。更多还原

【Abstract】 The administration punishment is one of the concrete administration action, however it shall be restricted the system of the administration punishment when it brings into the effect. As one of the branches of the administration punishment, the maritime administration punishment has its own characteristic because of its involving to the foreign affaires. Due to the customary actions and thoughts and other reasons of the development degree of the law, especially now our country has already entered into the WTO and the maritime administration punishment faces to the new positions and test, so we shall do more research in this field and try to perfect the system of the maritime administration punishment. And the reasons mentions above are the basis of writing this thesis.In this thesis, the writer firstly introduces the parties involving into the maritime administration punishment: the principal party of the maritime administration, the other party of the maritime administration, namely the principal party in the relations of the maritime administration law and the basis question of the maritime administration management.Secondly the writer generalizes and sums up the system of the maritime administration punishment which is in effect in China and discusses and analyse the problems in the maritime administration punishment. And the writer lists up and analyses three representative cases of the maritime administration punishment.At last the writer discusses the problems in the laws and regulations of the maritime administration punishment which are in effect and gives some suggestions on how to perfect the laws and regulations of the maritime administration.更多还原
