论我国应设置破产重整程序及其构想

【摘要】 一、 破产重整制度以程序法为主要内容，其核心就是由一系列程序性规则构成的破产重整程序，破产重整程序具有条件宽松、对象特定、主体多元、措施多样、程序优先等特征。 二、通过分析各国破产重整制度的产生与发展过程及破产重整程序的内容，从历史的角度阐明了破产重整程序产生与发展的必然性，并总结了各国破产重整程序的基本内容。 三、从我国破产立法的缺陷以及企业运作与破产的社会现实情况来阐明我国应当设置破产重整程序的必要性。 四、按程序效益论分析了破产重整程序的经济效益、伦理道德效益、社会效益和政治效益，破产重整程序存在较高的程序效益是设置破产重整程序的理论依据。 五、参照各国破产重整程序，坚持中国特色构想中国破产重整程序。更多还原

【Abstract】 1 Adjective Law is regarding as the main content of bankruptcy reorganization institution, the core of bankruptcy reorganization institution is the bankruptcy reorganization procedure formed from a series of procedural rules. The bankruptcy reorganization procedure has the characters of loose conditions , specifically objects , diversiform participants , diversiform measures and procedural priority.2 In virtue of analyzing the breed and development process of bankruptcy reorganization institution and the content of bankruptcy reorganization procedure in many other countries, the writer elucidates from the point of view in history that it was inevitable the bankruptcy reorganization procedure bred and developed, and summarizes the important and basal content of bankruptcy reorganization procedure in many other countries.3 In virtue of analyzing the limitation of the Bankruptcy Law and the actuality of social circumstance in our country, the writer elucidates that it is necessary to establish the bankruptcy reorganization procedure in our country.4 According to the procedural efficiency theoretics, the writer analyses the economic efficiency , ethical and moral efficiency , societal efficiency and political efficiency of bankruptcy reorganization procedure. That where is upper procedural efficiency is the academic foundation on which the bankruptcy reorganization procedure is established.5 The writer consults the bankruptcy reorganization procedure in many other countries and insists on the Chinese characteristic to contrive the Chinese bankruptcy reorganization procedure.更多还原
